Hi again

I have just sent Packet 3 back to the London Embassy and have a medical scheduled for March 29th. Today I received e-mail notification that my I-130 was approved and sent to NVC. How long does it take the I-130 from this point to entry??

Thanks

The I-130 is at NVC for a few months with the various forms etc that have to be sent back and forth. Once completed, forwarded to embassy....there is then the wait time for an interview. If Jame's shortcuts are used this can save a great deal of time and you can have the NVC stage completed as early as around 2 months, obviously determined by how quick you respond to the NVC generation of forms/fees, how quickly NVC generates the next step, whether there is security checks that hold things up, and ultimately how long the case takes to be complete once all documents/forms have been received. You can choose to enter on a K-3, continue the processing of the I-130 at NVC and then when complete and forwarded to embassy the applicant can return to embassy, get the CR-1 visa and gain the Green Card and re-enter. There would then be no adjustment of status in the US. There are many members opting for this as AOS can be a pain in butt from all I have read in the AOS forum :P If one has the finances and can easily travel back to Embassy then this is an option.

If I enter on K-3 and do not want to travel back to the Embassy, what happens with the CR-1??

If you have continued with the processing of the I-130 at NVC and then decide you wish to adjust status in the US.....you can notify NVC of this and they will return the approved I-130 to USCIS. If you havent continued with the processing at NVC stage the I-130 will be returned to USCIS when it doesn't hear from you and you will adjust status in the US with the approved I-130.
