My partner's green card is due to expire in October. He is planning a trip out of the country and will be returning after the expiration date. We have filed the AOS papers and have done the fingerprinting. We are waiting for either the interview or the decision.

My question is will he have problems boarding a flight from overseas with an expired green card. He did receive a letter stating work and travel was permitted but would a ticket agent at the airport recognize the letter? Has anyone used the letter for travel? Are there any other options?

If they already have a green card, then they are not filing for AOS. I think you are talking about filing for ROC(removing conditions/I-751) and receiving the notice that states his green card will be extended for a year. Is that correct?

Yes, the letter is used with the expired green card for travel and anything else the green card would be needed for. The expiration date is extended for another year while waiting for the ROC and 10 year green card to be approved.

Why would he leave with an expiring green card? If an immigration officer asked him "How come your green card is expired?" how will he answer this? try to renew the green card, it's fast and easy..

He doesn't file for a renewal. He is in the process of removing conditions and waiting to receive his 10 year card.

You are right. I am applying for removal of conditions. i screwed up somehow. So, the letter will suffice at the airport in Bangkok when my partner decides to fly back to the USA. I assume he isn't the first to do it. Thanks for the info and directed me to the ROC forum.

Just to be clear: not just the letter. He'll need the expired GC (which has his photo etc) AND the letter (which states that the GC is extended for a year).

Yes, it should be enough, but he should arrive in the airport in advance, just in case the person doing the check-in is not familiar with the extension letter and will try to deny boarding due to expired green card, and he will need to get supervisor involved and explain what the letter is.

When we traveled to Israel, they did not even ask us for the extension letter on the way back, or care at all that the green card was expired - they just looked at the green card and then looked something up on computer and checked us in.

I've traveled three times with my expired green card on the extension letter once to Canada, once the United Kingdom and once to Dominican Republic and no problems with gate agents, you just have to join the special assistance line so as another user stated please get to the airport early and provide enough time for the agent to call if they have question. also what I would advise is call in advance if you are concerned but most International Airlines have a clear process to handle this so it should not be an issue.

I had no problems, you are Dominican right? So you should not have any problems going back home to Dom Rep. Coming back to the states just ensure you have your extension letter and your expired green card. You can't use the automated kiosk so that is the only inconvenience. All the best and have a great trip.
