I'm going through the exact same thing right now but he was not a compulsive liar just a opportunist. You are not on the hook for the I-864, If you are granted an annulment then the marriage never existed and he gets deported. That voids your obligation for the 40 quarter, 10 year support agreement (I-864). I am using a lawyer whose specialty is immigration and family law. I went in seeking a divorce and she said after hearing my story (similar to yours) that I had grounds for the annulment. An annulment is the ONLY way to void the I-864. My annulment filing has been accepted and i will get my hearing date by the end of next week. Feel free to message me privately if you would like.

I also had a pre nup so he is entitled to nothing, he leaves with what he came with which is the clothes on his back and the wedding band he got from our ceremony, lol

Tell the court that if they won't give you the order of protection you want it documented for legal reasons. This way is something happened, your family has proof. Get away from him fast.

I have no where to go that is my house, I purchased my house 10 years prior to marriage, we do not have anything together, thank God, he never wanted to.

I did start the divorce on my own, i no longer have that much money anymore, more less to do a divorce, I tried to get legal advise, he did tell me, he would not sign a divorce, if it was going to affect his immigration status.

This is exactly what, I was looking for information that would help me through this process, not people telling, what I should have done, we are human and make mistakes, we learn from our mistakes and keep going.

I went through something like this about 5 years ago with a lady from South Korea. She claimed to be a Christian Missionary. Anyway, got her out of my house and never married her. She took a large amount of money from me. I was very angry, but gave it all to God. Two months ago, I saw her in Los Angeles. I was going to go up to her and demand my money, but I believe that God prompted me to take no action because He was taking care of the matter and by bringing us together the way He did, this revealed to me that He is in control. Anyway, have you changed the locks in your home. You have to make sure he cannot have access to your house. Don't let him and the situation control you and what you do. You need to take control of the situation. Pray this will all workout.

None of the criteria apply to my situation. So the removal of the conditions will not be taking place.

What the husband will do is flip the script, he will say that you are the abusive one, you threatened him with deportation if he didnt do exactly what you wanted. Add to that whatever bs stories he can attach. For a lifetime liar, it isnt too difficult. Dont doubt for one second that he didnt get advice from others who did the exact same thing.

He actually does have a legitimate chance to lift his own condition with or without your approval. If he does that, at least your affidavit of support should evaporate because you are not filing on his behalf.

I believe in Texas, if the legally served divorce papers sits without signature for 61 days, it will require posting an add in a local newspaper and has to remain x amount of days. It is imperative to have him served legally. At this point you know his exact location, in your house! You will inform the process server where he is and when. You can let them in your house. Once he is served then you can and should get him kicked out.

Removal of Conditions Begins by end of first week of February

 

  • February 5, 2019   - Printing package;
  • February 11, 2019 - ROC package mailed;
  • February 13, 2019 - Package delivered to Dallas Tx;
  • February 15, 2019 - Credit Card Charged;
  • February 19, 2019 - Electronic Notification Rec'd, Case Location LIN - Nebraska;
  • February 21, 2019 - Received NOA with 18 month extension for wife ONLY, not 14yo dependent who is on application;
  • March 12, 2019      - Notified USCIS that we never rcvd i797 for 14 yo minor, they provided a case # and submitted a Svc Request
  • May 2.2019             -  No forward motion, we called again and despite there was an officer assigned to this service request nothing happened/ no extension. We filed an InfoPass and have an appointment for Monday 6th for passport stamp.
  • May 6, 2019 - Attended InfoPass appointment in Philadelphia local USCIS local office for 930. This was for a never rcvd 797 for our 14yo dependent. Arrived 9:15, not crowded at all. No extra photos or fingerprint taken. We were in the car (lots of parking available) at 945. Pleasant female officer, she updated and checked for no changes. Stamped passport, explained is valid for 1 year. The took the green card which expired 5/4/19. No issues or problems.. I asked about the non receipt and she said it's pretty common.. 
  • August 23 - Biometrics NOA, scheduled for 9/3 @1pm
  • September 3 - Biometrics
  • September 4 -Fingerprint Review was completed
  • January 8 - ROC, Card Being Processed, Citizenship is next!
  • January 15 2020  - Cards Delivered

 

N400 Citizenship :)

 

  • November 28, 2020     - N400 Filed online and paid via CC
  • November 28, 2020     - NOA received electronically

My question is, if USCIS does take action, how long would it take if I reported as Marriage Fraud? or do they just wait until his green card expires 2 years?

Here is my situation:

He got here November 2015 got married, same month, right of way, he said, he did not want to waste anytime, I made the adjustment right of way, so he could get his green card, after that he got his green card everything went sour, I honestly believed, it was real love and he cared for me.

It was all false, all evidence submitted to USCIS were just pretended, not on my part but his, I really loved him and fell in love with him, this is killing me, I can not believe this happened to me, I did reported as fraud already.

I know he is at peace, because, he is going to use the mental abuse card, that I mentally abused him, I will explain why, he says that.

All through out the relationship, I have always know him to be a compulsive liar, I thought after marriage things would change because, we both have faith in God, I told him, that the only way this marriage would last if, we both went to church and turn our self to God completely.

I had several red flags, one was, as soon as he got here in the States, I say 2 months after, he moved in to the guest room, did not want nothing to do with me, I told him that, I would be withdrawing all papers and cancel everything, because there was really no relationship, as soon as I said that, he said, Ok so you are threatening me with deportation?

He got his green card, he has worked 2 jobs already, works for 3 days, stops goes to another job quits, he is not even working right now, sleeps all day.

I found evidence of an on going relationship with somebody else on the computer, I confronted him and of course, he denies everything, said it was not him, no body uses that computer, only him and myself, plus my son is always out of town, never goes in the guest room, it just the 3 of us living in the household.

He stays on the internet all night until next morning with his other relationship in Mexico, he thinks, he is going to stay here and bring his new love to the States.

This went on for months and months, I never to took action or reported, but I let it go.

I do not want him in my house, I have also made several police reports, he gets violent and can't control his anger when he gets mad, I have made several police reports.

He did threat me, if he gets deported, he would do something to me and my son.

Stupid me, I spent over 25 thousand on him, I do not care about the money, I just want him gone forever.

I consider, you can again turn yourself to god completely. Hope she/he helps. Good luck.
