I am so sorry to hear that this has happened to you. Please follow through with what the others have told you.

Make a plan to get set free as it will help you to recover emotionally and REMEMBER, this is not your fault. Put that head back up, straighten your crown and move on like the Queen you are.

Judge Judy (don't laugh :rofl ) threw out someone's evidence of recorded phone conversation because the other party (TX resident) wasn't aware of the recording...duh! never bother to check on the law...Thanks!

This is so sad to read....but one thing stands out...from the beginning he was a compulsive liar and you thought marriage would change him. Sweetie...why on earth would you want a future with a liar? I don't know you but I'm certain you deserve better and its time you realize that too!

Kick that dead beat liar out to the curb, change the locks and get that order of protection. You only need to document his threats and your fears. Then he will not be allowed near the home OR near you. If he breaks the order he gets arrested.

As for reporting him for fraud...thats a tough one from what I have read here on VJ. Instead of revenge, put your energy into getting free of this guy.

OP can't just kick him to the curb unfortunately.

Although She owns the house, it is also the marital home to the deadbeat. He still has a legal right of occupation for as long as they remain married to each other.

Best way is to file for divorce ASAP and have the court order to make him leave the house.

if you started anything joint with him-credit cards, bank accounts etc, close those down

why would she leave a home she owns for a guy she has known for a few months?

Looks like you are more interested in his deportation than your own safety. You helped prove that this is genuine and you will need a whole lot to prove "marriage fraud". I know we all can get fooled but you were and still using deportation threat against him. That's how he could use emotional abuse against you..You tried restraining order and couldn't get one even though it is fairly easy to get in Texas.

You can't just send him back.

Get away from him. Your safety and that of your son is important. And channel your energy to something else. All that you are doing now is leaving paper trail for him to ROC no difficulty.

^^ it is illegal in the state of Texas to record conversations between parties without consent.. She can't do that.

Not sure if that is accurate. Here is something I just found on the internet...I am not a lawyer. I would suggest you look into this further if you intend to record anything.

Texas Wiretapping Law

Texas's wiretapping law is a "one-party consent" law. Texas makes it a crime to intercept or record any "wire, oral, or electronic communication" unless one party to the conversation consents. Texas Penal Code § 16.02. Therefore, if you operate in Texas, you may record a conversation or phone call if you are a party to the conversation or you get permission from one party to the conversation in advance. That said, if you intend to record conversations involving people located in more than one state, you should play it safe and get the consent of all parties.

The law does not cover oral communications when the speakers do not have an "expectation that such communication is not subject to interception under circumstances justifying such expectation." See Texas Crim. Proc. Code § 18.20. Therefore, you may be able to record in-person conversations occurring in a public place, such as a street or a restaurant, without consent.

In addition to subjecting you to criminal prosecution, violating the wiretapping law can expose you to a civil lawsuit for damages by an injured party. Texas Civ. Prac. & Rem. Code § 123.002.

I am so sorry that you are going through this, after all the trouble of filing those papers. I agree with some of the responses here. File for divorce and restraining order. Your safety (and your son's) should come first. In two years, his conditional status will expire. If he jumps from job to job like he does now, it's possible he wouldn't even have the money to submit an application.

  • March 12, 2019      - Notified USCIS that we never rcvd i797 for 14 yo minor, they provided a case # and submitted a Svc Request
  • May 2.2019             -  No forward motion, we called again and despite there was an officer assigned to this service request nothing happened/ no extension. We filed an InfoPass and have an appointment for Monday 6th for passport stamp.
  • May 6, 2019 - Attended InfoPass appointment in Philadelphia local USCIS local office for 930. This was for a never rcvd 797 for our 14yo dependent. Arrived 9:15, not crowded at all. No extra photos or fingerprint taken. We were in the car (lots of parking available) at 945. Pleasant female officer, she updated and checked for no changes. Stamped passport, explained is valid for 1 year. The took the green card which expired 5/4/19. No issues or problems.. I asked about the non receipt and she said it's pretty common.. 
  • August 23 - Biometrics NOA, scheduled for 9/3 @1pm
  • September 3 - Biometrics
  • September 4 -Fingerprint Review was completed
  • January 8 - ROC, Card Being Processed, Citizenship is next!
  • January 15 2020  - Cards Delivered
