Hello, I have some questions about the I-212. Let me begin with the situation:

I am an american citizen and I married a non-citizen who was living in the US. She was already in removal proceedings at the time, but had been granted an extension. Within the time before her court hearing we had a child. At the court hearing the judge granted us another extension to have time to try to get all the paperwork done (I forget the names - but all the greencard, married now stuff). about 1 month later her father in Poland got sick and she wanted to come back to poland ASAP for the family could meet the baby and all that good stuff. Anyways we left before the next court date, never filed any paper work, and never informed the court. Sometime later some mail came to the address we had in the US saying she missed her court date and was in violation (dont know the specific legal terms) and basically was to be removed. Now it is 2 years later and we still live in Poland, but want to go back for two weeks for my sisters wedding.. so my questions are:

If she left before the actuall order of removal had been decided, with out expense to the US is she still considered ineligible to return (I think they said not for 10 years),

or

since we left the US before the court date and did not appear, does that still count as an order of removal being entered?

Is the I-212 the correct form for us?

Also, Ive seen it said that you must prove a strong financial connection to the country you are applying from, to prove that you are going to come back and not stay in the US.. what kind of strong connections are they looking for?

most importantly, what are the chances of actually being approved.. I dont want to spend the 280$ for nothing..

If she didnt do the things she was supposed to do before leaving the country, I would wonder if she "self deported" and that she can not just walk back into the country.

You really need to call someone to check on this, it sounds like the paper work was not paid attention to at all.
