Hi all,

My wife and I sent out the AOS package and money about 2 months ago. She did her biometrics one month ago, we just got an RFE today for the I-485 saying her sponsor's (me) income does not meet the pvery requirement guidelines and to provide proof of other assets or find a co-sponsor. The thing is that my AGI for 2014 was $19,940 and for 2015 it was $23,604. So why are they saying my income isn't enough? We sent 6 months worth of bank statements and paystubs along with w-2's and the letter of hire from when I started my new job of October 2015. My last job I was only making around $20k a year. This job I started last October pays double that. Should I get a more recent letter stating I work at the new job fulltime and what my salary is? What else could I possibly provide? I know the 2014 income is barely over the guideline, but my 2015 income is well over it and it'll be way over for this year. I'm at a loss here and really don't see why I should have to use a co-sponsor. We appreciate any advice.

What did you put on current annual income and what evidences did you provide to support that? While your last years income shows your financial health, the annual income for the year 2016 is what counts and it seems like you did not provide such.

So, if your annual income for 2016 is more than the threshold for your household size, re-fill i864, put expected annual year income for 2016 in current annual income box, provide your employment verification letter from your employer and recent few months of paystubs as evidences of current income.

Hmm, thanks. Is the i-864 the only form I should send again along with the proof of income docs?

Yes, you just need an updated I-864 to reflect your current annual income, not income from the past. You only needed to submit the 2015 tax transcript(or complete return). Only the total income(or AGI if you filed a 1040EZ) for the last 3 years needed to be listed where asked on the form. Those are separate from current individual and household income.

List your current annual income correctly, which would be hourly pay times hours worked per week, then weekly pay times 52 weeks. Provide the last 6 months of your pay stubs and a letter from employer stating when you started, that your position is a full-time permanent one, what your position is, and how much you earn. Include a statement that you met the requirement last year, and that shows on your 2015 taxes, and most importantly, you currently meet the requirement and are able to sponsor your wife. If you want to add in extra documentation, then provide the last 12 months of bank statements, and highlight your income deposits each month.
