VSC but do not "officially" live in the region?

So I have already sent in my I-129F to the NSC, but I can't help but think that I could've sent it to the VSC and used my parents address (I am originally from NJ). Has anyone done this or considered it? Hmmm....

I would have been tempted too. But honesty is the best policy in this journey. It's better to be safe and having to wait, then taking a chance of being sorry, IMO anyway.

I know its tempting, but remember your biography sheet lists where you work and other evidence you might submit could show a discrepancy between the adress you are claiming is your residence and your actualy residence. They do a security check and while it might go through without a problem, it could raise some difficulties that slow you down.

We went through CSC and it wasn't so bad- 89 days from mailing. There are a lot of CSCers here to keep you company! ;)

Timeline

I'm not saying this based on fact, but rather my experience so far. I live in North Carolina, but my file ended up at the CSC. I think it's based on where you fiance/spouse lives. Seems like all the Thai files go through CSC.

01/10/2007 Bought ticket to visit Pu on Valentines Day!

01/17/2007 NOA2!! via email

01/29/2007 NVC Left - Headed for Bangkok!

02/07/2007 Packet 3 mailed from US Embassy!

03/06/2007 Received response from Embassy - Packet 4 mailed 02/28/07. Interview scheduled 5/16/2007!

05/16/2007 Interview. Embassy requests passport amended. Luckily the turnaround time is two days in Bangkok.

05/21/2007 Pu returns to Embassy with new passport, visa granted. Visa issued the following day.

05/26/2007 Pu arrives in USA!

05/30/2007 Married!

06/26/2007 Overnighted AOS petition to Chicago Lockbox

06/27/2007 AOS petition delivered to Chicago lockbox, signed for by V Bustamante

You file based on the permanent resident location of the USC - it has nothing to do with what country the fiance is from. There is no way to file at VSC if you don't live in the region because, as posted, you provide your background information and it would have to match up!

Well it is quite possible to live in one area and work in another. I have people in my company who work during the week in Chicago and fly home to DC every weekend. I could've always claimed the same....

Personally, its not a chance I'd be willing to take that it might screw up the visa just for a few months difference in waiting time.

But that's just me.

It is tempting and I thought about doing it since I have family in the VSC region, but my conscience got the best of me and I didn't want to risk the chance of being questioned about it.

Yes... but you are supposed to file based on where you live, not where you work. And no matter what address you use as your mailing address, you are still supposed to give the one where you actually live on the G-325a.... so it would be a choice between lying on that and claiming to live at your parents' (lying to USCIS... bad idea!) or putting your real place of residence and ending up with your petition delayed/lost/ignored because you filed to the wrong service center! I think filing to Nebraska as per the instructions was definitely the right thing to do. The wait doesn't seem so bad... once it's over! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Well, where I would "live" goes to the VSC, where I would work is the NSC.

I am not debating what is the right thing to do, obviously the right thing would be the correct filing center. But I am just curious if anyone thinks it is indeed possible or if anyone has ever considered or done it. Thanks for all your input!!

Yes you could claim that and it could work. BUt what if you make this claim and then USCIS asks for proof of residence. I assume your driver's liscence, work employment records and other documents would only add to the confusion.

Well, where I would "live" goes to the VSC, where I would work is the NSC.

I was referring to where you actually live, not where you would "live" for the purposes of the application... because of the fact that you have to give your addresses for the last 5 years for background checks etc on the G-325A. That's what I meant - there would either be a discrepancy between the address you put on the I-129F and the one you put on the G-325A, or you'd actually have to lie on the biographical information form. When we sent ours we put my fiance's mother's address on the I-129F and the cover letter that we sent - but that was to use it as a mailing address as we knew he'd be moving out of his apartment soon after we sent it all off... but we still put his real address on the G-325A rather than claiming that he actually lived at his mother's house, if that makes sense. His mum lives in the same state though. I know lots of people use parents' addresses etc as mailing addresses through all this, for the same reason - I have no idea what would happen if the parent did live in an area that came under a different service center to where the petitioner lives.... it would probably be fine, but if there was any delay you'd end up worrying that someone at the 'wrong' service center had thought 'oh, this shouldn't have been sent here....' and just thrown it aside or something. Then again, they might not even notice or care! I'm sure it must have been done in the past...

Oh, when I said I think you've done the 'right' thing, I didn't mean 'morally', even, I just meant that it is probably safer that way even though NSC/CSC are slower - at least you know you've followed the instructions to the letter and won't have to worry about that. Good luck on getting a quick approval - I will stop rambling now! :)
