Receipt date versus notice date

Timeline

I was just wondering if it's the receipt date or notice date on NOA1 for AOS that is the day that out-of-status days stop accumulating?

October 2005: Met online playing World of Warcraft

December 19, 2005: David flies to America on VWP to visit

February 26, 2006: Married!

March 14, 2006: Filed I-130 ... by itself. Oops.

June 21, 2006: I-130 approved

March 12, 2007: Mailed I-485 package

April 5, 2007: Biometrics

May 30, 2007: Email notification: EAD approved!!

June 4, 2007: EAD received!!

July 24, 2007: Interview 8am APPROVED!!! Day 133 from filing. Emails for card production and welcome letter.

July 25, 2007: Passport stamped

August 6, 2007: GC in hand

The difference is most probably a couple days ... does it really matter ? The wait could be months or even years if you were to get stuck in name checks :wacko:

The difference is most probably a couple days ... does it really matter ? The wait could be months or even years if you were to get stuck in name checks :wacko:

Yeah, it matters because on March 19 my husband will have overstayed 365 days. They received it on March 14 and the notice date is March 20.

The Notice Date is the date that someone ordered the notice to be printed. Or, it may be the date that the notice was printed. Either way, it refers only to the notice (the piece of paper) itself.

Right, so then it (the receipt date) is not the date actual acknowledgment of having an AOS pending? Which would mean we would go by March 20, the notice date?

As I wrote, the Notice Date refers only to when the notice was ordered or printed.

Whether your husband has 360 days of overstay or 366 days of overstay, he does not want to leave the USA. Either way he will be gone for a long time.

I know, he's not planning on leaving, I just wanted to know out of curiosity on the off-chance that his AOS is denied ... then it would become extremely relevant. Maybe I'm misinterpreting what you're saying, but I'm still not sure which date he stopped accumulating days out-of-status. I understand that the notice date is when the notice was ordered to be printed, I just don't see which date is the relevant one.

The actual receipt date (not NOA) is recorded as the date status changes. At least this is what I assumed based on the priority date of December 8, 2006 (date application was received by USCIS) that is marked on my AOS interview letter.

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.
