So i have my dilemma here. The wife's immigration is at the NVC stage for my now, i want to 86 my attorney. She told me in February to not to worry about my taxes and get an extension. Well i did that and it kind of messed up my FAFSA as well, but nothing terrible. So last month she asked me why i have not filed Taxes.. i was like #######.

Anyways long story short here, i have not done anything yet, paid no fees yet, and slowly getting copies ready, but did speak with NVC and she told me to change agent to myself if that is what i want to do. Is it wise to do it now? This is all so foreign to me and confusing. any help would be great!! Cheers!!

I changed mine from a lawyer to myself after sending off the first packet during a fiance visa process. I love this forum, they are very helpful and you can typically search the forum and find answers to most questions that you can come up with.

I'm not sure exactly what your question is. If you want to do the process yourself, then get rid of the lawyer and do it yourself. I also suggest filing taxes asap since you will need those as proof of income during the process. I am not sure how to go about getting a Tax ID # for your wife. Maybe ask the lawyer before sacking him/her or possibly someone here has a suggestion.

Good luck!

Well I sent off my taxes and also sent off W-7 form ( to get my wife a tax payer I'd) so that step is in process

Sorry. I hope this can clarify what I mean.

My question though is should I fire my lawyers before paying the NVC fees or after?

My question is how were you able to file jointly without an ITIN (taxpayer ID). As for the fees, remember the NVC prefers you pay online and via EFT.

My CPA had my wife fill out IRS form W-7 (Taxpayer ID) She did it in both English and Spanish. Then I had to mail them to the W-7 and my Federal Tax forms to the IRS in Austin, Tx. So according to my CPA Tax lady. The IRS will process the W-7 form then process my Federal Taxes. I hope they send me copy though of the Tax payer ID because I need it for my Iowa State taxes.

This is exactly how I processed my 2015 taxe. Y

Once the W-7 is processed, it will be sent to the beneficiary. It will be on an official letter sent by the IRS. So you can definitely obtain the ITIN once the letter is received
