I-864 questions- CR1 visa

Hi,

I've had a look through other I-864 posts but hoping to get some clarity... got the interview this Friday so want to be sure. Have all documentation ready but the following I-864 questions:

1- Do you need a photocopy of the I-864 form and any associated documents?

2- My husband did not file a tax for 2013 and 2014 and we have the documentation to show why this was. However as they only ask for the last years tax return, will they ask to see this?

3- For the last years tax return, I have his '1040 U.S Individual Income Tax Return'- is this what is required with the I-864? On top of this I also have a 2555-EZ- Foreign Earned Income Exclusion form.

The requirement is that he filed a return any year he made money over the filing threshold. Sounds like he had UK income in 2015 and he took the Foreign Earned Income Exclusion with Form 2555EZ. Yes, that form a s part of his tax return and goes along with the Form 1040 and will be turned in with the I-864. If he worked abroad, then he wouldn't have a W2 for that income. Those only come from American employers. I mention that because most things say tax return and W2. In case the document collecting person asks where the W2 is, you can be knowledgeable and say that he didn't get one because he had a foreign (UK) employer.

Do make a copy of all that for yourself simply because you never want to give away your only copy of something in case you want to look at it again. The interview will not require a spare photocopy.

Only the most recent tax return has to be turned in (or a reason for not filing) so theoretically any info about the previous years does not have to be included.
