AOS - Interview without spouse

Hi everyone,

I hope you all are doing well. I am hoping to find some answers here.

My husband and I applied for my Green Card early June - viz. my timeline. Today we received online update that our case was scheduled for the interview as well as interview letter in the mail. I spent a while being on a phone with USCIS (both, military line & regular line). The problem is that my husband is due to deploy fairly soon and prior to that they have crucial training which is absolute must to attend. There is no way my husband will be excused for that. That means he won't be able to come. I tried to call USCIS to ask what should we do, whether we should reschedule interview or whether I am allowed to go by myself with supporting documentation.

ALL I was told was that coming to an interview without my husband will negatively impact our case & that my husband MUST attend. I was also told to write letter to our field office (which I did and should be delivered by tomorrow morning) with explanation and see what they say. My question is. Has anyone been thru the same? How did USCIS deal with that? Should we make an INFOPASS appointment or is there anything at all that we can do?

Thank you,

I appreciate any advice.

Hope y'all have a wonderful day.

Michaela

If he'll already be deployed on your interview date, bringing proof of that and attending the interview on your own is fine. If he'll still be training stateside on your interview date, maybe reschedule it, so he's already deployed at the rescheduled date. I know for sure that being deployed excuses his absence but I'm not sure about the training.

Take a copy of his orders to the interview and a letter from his CO explaining that he could not under any circumstances be at the interview due to military commitments. That should suffice.

I am in the same situation, called several times USCIS and they told me to go by myself. I got a copy of his orders and gather all I could to bring it to the interview next week.

Good luck to you, please share your experience, thanks!

People with deployed spouses can attend the AOS interview alone. The person you spoke to on the phone was wrong.

Hi! I was in the same situation. I was left here in Maryland while my husband was in Vicenza. I just brought his orders along with several evidences of our marriage. Interview didn't last for 10 minutes. Everything went well. I got my 10 year greencard now! It will go well. Don't stress about it. Just tell your hubby if he doesn't have work on that day to be on a standby via skype. Goodluck.

Hey I don't know if anybody here can help me. There is a strong possibility my interview will be scheduled for next month. My husband is in infantry and goes to the field a lot. He told me that he will be leaving in June for the field again. What happens if on my interview date he is not here?
