Hi All,

I have a friend that was brought to the US as a child without inspection, she has been married to her US citizen husband for several years, and they also have a child together. What path would she need to follow to get her status fixed?

I don't believe she has. She just hired an attorney (we just realized today how crappy an attorney he is) a few months back, and finally heard back from him today about her case. He said she needs to go to Juarez, but had no idea for how long, when, or what she needed to do before then. He admitted he wasn't sure as he "didn't take very good notes" and would call her back in a couple of days if he found anything else out. Family and Friends suggested to her that she get another attorney ASAP, so just wanted to see what would be the best path for her so we can compare information with what the new attorney says.

Hi All,

I have a friend that was brought to the US as a child without inspection, she has been married to her US citizen husband for several years, and they also have a child together. What path would she need to follow to get her status fixed?

There is no way your friend can adjust status to lawful permanent residency in the U.S. since she entered without inspection by a CBP officer. She must seek an immigrant visa overseas. Her option is to apply for an unlawful presence waiver in the U.S. first and if approved, she can leave to go seek an immigrant visa overseas at a U.S. consulate in her country. This is not a do your own thing as waivers are complicated. She will need an immigration attorney that specializes in waivers for her best chances of approval. If she leaves the U.S. without one she will trigger a 10 year bar (assuming she's now over 18 and has been unlawfully present for over a year). With an approved waiver, she can safely seek out the immigrant visa without fear of the bar. Caution, USCIS could seek removal proceedings against her though if waiver is denied. It's all up to their discretion. That's why it's best to be handled by an immigration attorney.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

I-601A provisional waiver should be explored first. If your friend qualifies to file it, then it can be filed while she's still in the US and she can wait for the results while she stays in the US.

If approved, she'll only have to go to Mexico for the medical and IV interview.

Before all that, though, her husband needs to file a STAND ALONE I-130 for her and that needs to be approved.

Get DACA, use AP, then adjust is a better route. Not sure what the status of DACA is right now or if you can get it anymore.

And FIRE that Lawyer, what a WASTE of money!

Don't close a thread based on ONE answer. It might be wrong.

Check out immigrate2us.net as they deal with cases like that often.
