Case possibly missing......

Hello everyone,

I filed for AOS along with EAD and AP at the beginning of July and Recieved my NOA1 copies mid July, I've heard nothing since, I spoke to USCIS tier 1 the other day just asking as I have not Recieved my biometrics letter yet and it has been past 30 days the guy took my information down and told me someone would call back.

Today a tier 2 person rang me back and I just explained what was going on, he asked for my reciept numbers from my NOA1s which I gave him and my information and he then stated he could not find me on the system, he asked when did I recieve my NOA1 letters when was the check cashed etc which I told him.

He then said he can't find my case with the case numbers or with my personal information so he can't help me and he told me to email the lockbox support with my reciept numbers to see if they can locate it. He did state there could be a delay so just to wait another week to see if my biometrics letter comes through if not to call again.

So I'm now really worried that they have lost my case, I know sometimes it takes longer to get the biometrics appointment but if I get no response should I resend it all including a copy of my NOA1 receipts that I got? I really don't have the money to send it all again.

I'm so frustrated right now.

They will find it. I don't trust the story from the CSR either. Do all your follow-up, call back, email whoever, etc. You could also make INFOPASS. But they will find it.

And USCIS sucks but they wouldn't make you pay twice. You got the NOA1 so you ARE in the system.

Thanks for your reply, the guy i spoke to just didn't sound interested and didn't seem to care he kept making it sound like they had lost it!! I've emailed the lockbox but just wondered is there anyone else I could contact or send a service request?Someone said I should try my local office where they do the biometrics (Phoenix) but doubt they could help?

I've seen cases on here where some people have waited 3 to 5 months just for their biometrics letter which is a very long time! Just hope I don't have to wait that long!!

I think Lockbox support is for queries where the NOA1s never came but the check was cashed. You could try them just to check anyway though.

Then I might call back USCIS and get another Tier 2 and see if get a more satisfactory answer.

Then I might make INFOPASS at your local office and talk to a real officer. They can see all the computer stuff and they are more human and helpful.

Then I might email the USCIS Ombudsman.

Files are not just lost. They might have gotten sent to the wrong place, but they can be found. Don't worry too much.

The date of your biometrics doesn't make your EAD/Ap come any faster, unless your bio happens after 90 days (which is rare). So as long as you get your bio done in the next two months you wont lose any time.

What does it say when you put your case number on the USCIS status case tracker thing?

Thanks I'm happy to wait a week and see if anything happens then chase USCIS back next Monday, when I type the case numbers in it comes up with the validation error and that the numbers are not recognized and to contact USCIS

One thing I learned when I had to get my emergency advance parole is that they will give you case number before they even scan your file in. So it could be that they are just slow and haven't actually scanned your file yet (it's just a theory though from my experience) sounds kind of strange that it would take long but it could explain why they can't see it in their system.

When I came to the local office with my case numbers to get my emergency advance parole the immigration officer told me that he couldn't see it in the system so it was probably not scanned. But since I clearly had my NOA1 it was all good. I don't know how long it takes for them to scan it but it could be what is causing you to not see anything.

Also sometimes the website where you check your case number is malfunctioning and since the customer service people at USCIS only uses that to give you information they are unable to see it too and then they come up with some BS answer as to why. That's why you should ask to speak to a tier 2 or go for an info pass.

Still no biometrics letter for me but I got a letter from USCIS as I had a service request put in last time I spoke to them on the phone, it basically says they can't help me and to make an infopass appointment at my local office as they require more information, what more information could they need? I'll have to speak to my wife tonight and see if she can take me to the office for an appointment when we get one, just means she will have to take time off work to take me.
