214 (B) refusal

Timeline

Hi my parents got refusal under 214(B) for the tourist visa. Both are 60+ in age, Father retired and getting pension, owned house and agricultural land and Mother never worked. I am the only child who is in the USA, Other children (1 son and 2 daughters) are in Pakistan.I showed my funds (bank statement) for their visit and attached a letter from my employer and recent salary slips showing my earning . My question that should we apply again with same condition because I believe there was nothing wrong with the application and they do have strong ties to Pakistan.

6/30/2014: Received interview waiver letter

02/27/2015: Green Card received

12/02/2017:  Status changed Biometrics appointment was schedule (Waiting for letter upload to my account )

12/04/2017: NOA received in the mail

12/04/2017: Biometrics appointment letter uploaded online schedule for 12/21/2017

12/05/2017: Early walk-in Biometrics 

06/12/2018: Interview scheduled 

07/17/2018: Interview (Approved)

07/20/2018: Oath ceremony scheduled (for 08/11/2018)

08/11/2018: US Citizen

They can apply as many times as they're willing to spend $320. Expect a similar result if reapplying without a material change in circumstances since the refusal.

Here's the thing. Your parents need to apply on their own merits. Your finances have nothing to do with their approval. That said, they should have proof they can afford the visit at their own expense, and transferring large amounts of money into their bank account, could be considered a red flag.

as said you and your financials have nothing to do with them applying for a tourist visa, they have to show their own financials and that they qualify on their own to pay for trip and also have strong ties to return,

on the contrary, it's more like they depend on your finances to come, and that they will overstay and you will end up filing for them if you are a USC. they have more evidence of strong ties to the US. than strong ties to their country

unless anything changes, they will be denied again

Its only on their merits they can qualify, so USCIS can keep denying if nothing changes like

own bank accounts, stocks or other funds,,,,your finances comes into play ONLY if you had

petition them for an immigrant visa, all that you did makes it see to CO they have immigrant

intent & your other siblings will live in their home or rent it, & collect the pension & send it to

your dad...They can apply again but change the situation, however they must tell the truth

about prior app. they keep all info fro past apps
