HELP! Missed interview date due to being out of country

Hi everyone,

I'm an april filer, got my EAD/AP in late June and then had to leave the states for a conference, and also in order to plan/ have our official turkish wedding..

I have left the states on June 26th, and I just arrived today, August 14th. As I came, however, there was an unpleasant surprise waiting for me. It appears that I have received an interview notice, scheduled for July 26th. I have not received any updates on any of my cases while I was gone, except for one on July 30th, which showed the cases to be updated, but didn't show any changes in the status. I was, until today, out of the country.

Now, my question is, what am I going to do? I can't start the whole application anew, and I didn't seem to have gotten any denial notices.. Is there any way I can tell them that I was, and I told them that I was going to be, abroad on July 26th?

Please tell me what do do, I'm really panicking...

June 2010: I went back to Turkey: time for some long distance relationship!

September 2011: Came back to Chicago to start my graduate degree!

March 2012: We moved in together.

fast forward, October 17th, 2015: We got married at our backyard, with a beautiful ceremony.

January-February 2016: We were both in Turkey together!

April 1st, 2016: Sent in the package: I-130, I-485, I-765, I-131

April 4th, 2016: Package received, signed by CHYBA.

April 10th, 2016 (Day 6): NOA1 received

April 11th, 2016 (Day 7): Checks cashed

April 12th, 2016 (Day 8): NOA1 Hard copies received

May 2nd, 2016 (Day 29) Biometrics Appointment received, biometrics scheduled for may 12th.

May 3rd, 2016 (Day 30): Walk-in biometrics successfully completed

June 7th, 2016 (Day 64): Expedite Requested on EAD

June 9th, 2016 (Day 66): Proof of job offer sent to uscis via fax

June 14th, 2016 (Day 71): Expedite Request was assigned to an officer for response

June 16th, 2016 (Day 73): EAD status changed to "New Card in Production" and AP changed to "Approved"!

June 20th, 2016 (Day 77): EAD status changed to "Your card was mailed to you"

June 23rd, 2016 (Day 80): EAD/AP Combo Card Arrived!

Missing a scheduled interview is an automatic denial. If you do nothing, that's what will happen.

I'd suggest making the earliest Infopass appointment you can and explaining the issue to an IO face to face. You may be able to convince them to give you a second interview.

Worst-case scenario if they won't budge on the denial would be to re-file.

Yah, this is serious stuff schedule an infopass appointment ASAP to request a new interview date before you get denied. Also call USCIS hotline ASAP and try to avert this scenario by speaking with a LEVEL 2 officer as well.

I have just set up an infopass appointment, but the earliest available was August 24th. I'm calling the hotline as well- but I can't get through to a representative. What time zone is the 8am-9pm service center?

Also, the information on the hotline also still says the fingerprint fee was received. I have never received any other updates online or via text on the AOS since I submitted the application, so I don't understand how they sent an interview notice without me ever knowing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I just got off the phone speaking with a representative. She said she didn't see anything about the interview and that my case still appears to be in process.

In the meantime, she wrote a request for rescheduling on my behalf, explaining that I never received any updates on the case and I was abroad when the notice came/ the interview was scheduled. She told me that I should hear back in 15-30 days.

I'm also confused because I entered the country yesterday with my advance parole. Wouldn't that be cancelled as well?

With this request filed, what should I do? Should I still try a walk in, or go to the infopass? Or should I wait to see what happens with the request?

Were you actually transferred to speak with an actual level 2 officer? Mindful as level 1 peeps just see but what you see on your computer and are mainly contractors. Level 2 officers have access to to stuff. If you did then good, you should also try visiting your local office to clear things up just to be safe.
