Hello,

I'm hoping someone here can be of help to us. Here is the situation :

female Filipino citizen married to make US citizen and now hold green card as permanent resident of US. Female is married in the Philippines (where there is no divorce), but was divorced in the US prior to the marriage and adjustment of status. Problem now is the passport from the Philippines has expired, and it had maiden name on it. Would like to travel back to the Philippines for a vacation and then come back to the US without any problems. What can be done here? Is it possible to change Philippines passport here in the US to my married name and travel to the Philippines and back? Or renew my Philippines passport here in the US under my maiden name, although my green card and ID are under my married name? Or, would applying for US citizenship be the easier/only way around this? I know the fact that I am technically still married in the Philippines (although divorced from that here in the US) complicates the situation. Thank you in advance

In order to change your passport to your married name you must register your marriage in the Phils (can be done at the same time). You have to register your original divorce in the Philippines...they will recognize divorces in another country....unless your first husband was also a Filipino citizen.

Thank you for the response. Wouldn't I be unable to leave the country though as is right now though ? Also, my first husband (married in the Philippines) is a citizen of the Philippines

Kind of a weird gray area, you have to show proof that you haven't applied to be a U.S. citizen...a green card is the document they'll ask for. That's in your married name...so they'll make you do a report of marriage....which you can't do until the previous marriage is annulled. Also for some reason women must present a marriage certificate when applying for a passport anyway no matter what is on the green card (I don't know how they could prove if you're married or not). Anyway, I don't know of any option for you to renew your passport until the previous marriage is annulled. Unfortunately, since you and your ex-husband are both filipino citizens, the Philippines won't accept the divorce decree from the United States. Filipinos can never divorce each other even if the marriage and divorce took place in a different country such as the U.S...but you seem to know that part.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Or if she divorced the USC husband and not the other way around.

As she stated he is a Filipino citizen so she must go through the annulment process. This situation is pretty messed up.
