Next step K1 visa denied (merged)

Timeline

Visa denied August 11th,Am beyond upset.CO think we won't marry within the 90days. official reason for denial is "applicant found ineligible under section 221(G)" don't know what to make of that". What are my options and Next step. FYI my next trip to Ghana is October. We don't have any red flags, expect my fiancée had previously applied for 2 F! visa two years ago and he was denied( could this be a contributing factor).

Really sorry to hear. But did they say denied and they are returning petition to USCIS or that you are in AP?

  1. What questions were asked to make them think you wont get married?
  2. Was this a long relationship?
  3. Did you have alot of visits?
  4. Did you meet his family and show pictures in your petition?

Yes the 2 denied F1's (Student Visas) are a Red Flag and shows he is trying to get to US. And the CO may look at it as he will get here by any means necessary. He failed twice with that Visa than met you. So That's major.

For your situation it seems your only recourse is to marry when you go in October. Another filed K1 would be a waste. They seem to see lack of commitment so you need to show you are committed and ready to marry now.

Seems that they weredocuments missing... dud you sent both letter of intent to marry??? In my application we sent my now husband and mine letters if intent... maybe that was missing... did they gave him a paper saying what us missing or any other instruction?

You did not recognise his previous attempts to enter the US as an issue, which make wonder if there is anything else.

I am sorry you got denied. Yes, the previous visa denials could be a factor, especially if you are of the same culture, religion and education level otherwise.

Were you able to find a way to show the visits you talked about in your previous topic http://www.visajourney.com/forums/topic/596993-upcoming-interview-and-expired-us-passport/ ?

If he was just asked for extra evidence, what was he asked for? If the visa was denied outright, my suggestion would be to marry during your upcoming trip in October, and then go for a CR-1 spousal visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hmmmm I see in your previous thread a warning and I know Ghana and they do frown on long relationships not marrying. Being in a relationship for over 9 years shows lack f commitment. "The main notorious question for relationship over 3 years are "why haven't you married her after all this time"?

This is the basic fact of the matter. Hard to explain why being in a relationship almost 10 years and you don;t get married.

The two failed F1's were they before you meet or during your relationship? These are major big flags you didn't heed to.

We were in a relationship two's prior when he applied for the 2 F1 visa's. Marriage had always being on the table but I wanted to wait for a while( since 2010). I have been in US since age 12, am now 31 years. We went to the same primary school when I was young. We reconnected during a night out with old school mates in 2007.

All my friends and key members of my family are here in the state. Therefore I wanted my marriage ceremony to take place here. Getting married in Ghana was never an option for me. However, it obvious that's my only choice

I have visited him 5 times. October will be the 6th time, twice this year. Each visit always lasts 4 to 5 weeks.

We weren't missing any documents. The second interview we provided everything requested from the first interview.

My last question is should I file the marriage pro cress through a lawyer or should I do it myself. What are the right forms to use. Must we have have the same bank account? Currently he's on my life insurance policy at work.

For you I would suggest a relationship timeline since it was so long so they can really see all those visits and duration.

Also attach a Evidence list of some ideas. No it's not required or needed to be added to a bank account. You don't live together.

And get some affdavits ( like 3 or 4) from dad, mom immediate family here and there since you all have meet each other.

Do it yourself. Nothing a lawyer can do for you you can't do yourself. And lawyers don't make it faster, easier or guarantee an approval. You can do it all yourself. Thus being more in control of your case.

I will say do it yourself. People who get refused k1 in Ghana and marry and do cr1 have a huge success. Good luck and sorry for this outcome. You will win in the end.

Before you go in October I'd start preparing my documents to be submitted for the CR-1. Then when you get home all you have to do is sign and date them as well as add the marriage evidence to your packet. It will cut a few days off the wait which is always good.

Different country. Ghana is tough on long term relationships that don't get married. Some times Nigeria is also Its all about how many visits in that 6 years (I hope at least one a year. But its all a case by case. Hopefully if asked he can address why 6 years and no marriage.

It depends on age of the beneficiary and petitioner. Prior marriages so may factors to eve consider. But you have to think like a CO. Why 6 years and no marriage. Are you committed or not?

Saying you want to get married in front of family in US is not good enough and shows you aren't sure. Cuz well what if your family don;t like them Then what No marriage? They are giving a Visa for you to marry so they want to be assured that will happen in 90 days.
