My husband has been in the US since 1990, he was brought over when he was 5 from Mexico. We were married in 2004. We filed an I-130 which was recently approved and the NVC assigned a case number. It says with the I-130 once my husband enters the US at a Port of Entry he will be a permanent resident, but he is already here. Will we have to go to Jaurez, Mexico for our interview and if so how can we do that if he is not even here legally, won't he get banned if he leaved the US....we are so confused. Please help us!! 3/12/2007: I-130 APPROVED!!

4/25/2007: NOA Rec'd

4/27/2007: Biometrics Appt. Letter Rec'd

5/10/2007: Biometrics Appt. 10 AM....got home & rec'd RFE Letter = ( Both touched

5/26/2007: Response to RFE Mailed

02/19/2011 - Mailed N400 Packet to Phoenix Lockbox

03/08/2011 - Notice of Biometrics Appointment Mailed

03/22/2011 - Biometrics appointment at 3pm

04/14/2011 - Letter for Interview/Test at local office received

04/20/2011 - Yellow Letter today listing items for us to bring

06/05/2011 - Interview....APPROVED

06/17/2011 - OATH!!!! Hubby is NOW a US CITIZEN!

If he is here illegally once he leaves the country he will be banned for 10 yrs. You will have to file a waiver but I'm not sure how to go about it. I'm sure someone will be able to add a comment.

Please go to the I-601 forum at www.immigrate2us.net to find others doing exactly what you are doing. You will be filing a waiver, and you will want to be prepared for it ahead of time.
