please help tax return 2015

I am in process of submitting all documents to NVC for F2A, I filed my taxes for 2015 as single and my lawyer is asking me to file taxes as Married filing separately.(My wife is in India never been to USA)


And my tax prepare is saying, I cannot do that as my wife has never been here and she doesn't have a SSN.



who is it correct???my case complete.is it any problem during interview???

Neither are entirely correct

You should have submitted your 2015 return either married filing separate or married filing joint. The easiest is MFS, you complete the return, print it out and by hand fill in the space where your wife's ss# belongs with NRA (non-resident alien). Then you mail it in. So it is not as simple as filing as separate, but it is the correct procedure.

With that said, there are people who file as single all the time and do not encounter problems when it comes to visa issuance, although theoretically it could cause a problem.

NO, when you file taxes in the spring, you can fill out a W 7 asking for individual taxpayer ID numver (ITIN) for your spouse

only can do this at tax time

then you can claim your spouse although living in a foreign country

this ITIN also allows you to add to joint checking account to show commingling of assests (good for interview)

I added my husband in 2011 when he was still in morocco as we married in 2010 so I applied for ITIN with 2010 returns

He got his SS number only after coming to the US in 2015

I was able to claim him 2010, 2011, 2014 long before he came to the US

It helped us greatly to have him on our tax returns (and i shared this rebate with him) and to have him on bank account with me although he could not have a debit card till he entered the US

also is a good idea to have a POA from spouse allowing you to do this

Since you are collecting documents for the NVC phase, i suggest you file for amended tax return as Married Filing Separately. If you file as MFS, you don't need any info from your wife. As said, you put NRA on SSN box for your wife in 1040 form. It can only be filed through mail not online at this point.

Since your case is F2A, even if you need to wait say 1-2 month for IRS to process your amended return so that you can print or request new tax return transcript, you will not be losing processing time anyway unless your PD is already current.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

The lawyer is correct. File married. Whether that's "together or seperate" is up to you two.

Since you are collecting documents for the NVC phase, i suggest you file for amended tax return as Married Filing Separately. If you file as MFS, you don't need any info from your wife. You can amend last 3 yr of Tax return.

But as far as I know I filed my 2015 tax as single and NVC approves my partition. Let see if Intervew creates any problems or not.
