Greeting everyone,

I just sent all paperworks today to the AZ Lockbox. What will happen next? I have greencard, and I am trying to sponsor my husband (he is currently on his Post Completion OPT from school, will expire in Jan 31, 2017)

What do you think we should do?

After I got my Greencard. We have been dating for 3 years before decided to get married. We don't have a wedding ceremony, just a court wedding. He is from Sri Lanka and I am originally from Viet Nam

The spouse of a permanent resident is in the F2A category, which currently has a wait of around 1.5 years. So his OPT will almost certainly not last him long enough for him to be able to do Adjustment of Status. If he cannot maintain a status in the US for that long, he will have to leave and do Consular Processing in his home country.

Hi,

As already mentioned he will likely have to leave. Don't have him overstay which would make things even more complicated.

welcome to visa journey,, same case my wife is also GC holder in USA, and she would be my sponsor. my priority date is 17th june. 2016, PD is when your case received. then they will send you a NOA1 (Notification Of Action) then it takes almost 4 to 5months for approval, means your case would be transfer to National Visa Centre (NVC).... and so on.. i wish you best of luck, also prayers for all...

Another question came up while my husband and I were talking last night.

After his OPT ends, he will likely to start his Graduate school in the U.S. right away, because we are thinking it will be faster to do the Adjustment of status in the U.S. than waiting for his visa in his home country, is that correct?

If he does choose to stay here for his graduate school, what will happen next?

What will be the process until then? While doing grad school, will he be able to get an Employment Authorization card (EAD card) until our case are finish?

When a visa number becomes available for his priority date, he would apply for AOS (with form I-485), and he should also apply for EAD (with form I-765) and AP (with form I-131) for free at the same time.
