my wife have mood seings. She is very controlling and blackmails me . for example today what she did was horrible. i went out and she wanted me to get back home early. what she messages nd is that she is going to report the police that her car is stolen...it is her car and
i am registered as a driver on her car insurance...i am working full time and will soon buy my own car....just got job before 5 months...these things happen everyday...she is very possesive and might be in depression ... and i am trying to help her out but this is unbearble.

if suppose i apply for waiver on battered spouse without divorcing her and i am currently living with her,,,, and suppose uscis refused it...wikk i still have chance to apply with my spouse after two years,,, i have no plans to leave my wife but i need little relaxation and freedon...

If you divorce and have proof that the marriage was entered to in good faith you can get a divorce waiver if you have not yet removed conditions on your greencard. Not sure what you mean by a "waiver for being battered" there is no such thing. Where in the immigration process are you? You have given no details

If you divorce and have proof that the marriage was entered to in good faith you can get a divorce waiver if you have not yet removed conditions on your greencard. 1. You have what is called a conditional green card, not temporary.

2. You either want your marriage to work out (why would you with an abusive spouse) OR you want to file using VAWA, BUT NOT BOTH. And you certainly don't use VAWA while living in the house with the abusive spouse.

3. Like mimolicious said, if you file for divorce and apply to remove conditions with a divorce waiver and provide evidence that the marriage was entered into in good faith, then you will have the upper hand and no letter that she can write will cause USCIS to deny your application. Please do not listen to or believe any US spouse who claims they will "take your green card away" as a means to control you or because the marriage is not working out. US citizens have no such power.

4. This is an immigration website so if you want to stay married to and live with your abusive spouse, you really have no business asking questions here because you are not really seeking any immigration advice. You cannot file for a waiver as a battered spouse and then go home and have dinner and snuggle in front of the TV with that spouse.

If you divorce you don't have to wait either. Based on what you wrote you should not file an abuse waiver I-751, because it would most likely get denied.

Either patch things up and file jointly when the time comes or divorce and file a divorce waiver I-751.

As posters have said, either divorce and file with a waiver or fix your marriage and file together.
There is no in between. Are you beaten and battered or just nagged about the car ?

I have no idea why i cant get abuse waiver. I was not just beaten but physically abused as well. I am seeing pcychologist for the mental damage i have suffered from being in this relationship. I had filed report... my office and boss knew it is happening with me because they ssee me with red eyes everyday ...spending sleepless nights.....i have office friends willing to testify for me... i have a joint checking account...and i can prove that only i was the one depositing cheques in that account and that is the only thing i have in this country...joint car insurance...joint health insuance....vacations photographs to different states....marriage ceremony more then 300 people were invited....my phycsical exams report showing that i give sperm test,,,,,and wanted to have child

.... my wife have good credit but sshe didnt add me to her credit card and i still have no credit ... I had told about the circumstances i am going through and some organizations are willing to help me out as well...including the polaris project...they are willing to testify that i asked for there help and i was blckmailed constantly.... she is in depression and i want to help her out...but it is damaging me..... i suspect she will try to deport me if i left her and do something with her self...that is why i just wnt to take things from her hand that she can deport me and try to have a family with her......what i knew is 75% of waiver cases are rejected.... and if i am deported back... if she becomes pregnent my child would suffer alot....

Decide if you want to work on the marriage or get a divorce. If you have proof of entering the marriage in good faith you can remove conditions with a waiver.

Did you read the pamplet on domestic abuse? Because if I understand correctly she has been physically abusing you?

Also, I agree with previous post, stop having sex with her. Why would you wanna bring an innocent child to this mess? Why would you even want to have a family with someone who treats you like this?

If she is suffering from depression or some mental disorder its her job to seek help for it, not yours.

wow!!!!!!!!! i came here and entered in a good faith marriage... i was in a relationship for 3 years before entering in that relationship that is why i care...getting a 10 year gc is not a big deal if you have evidences and everything....but i am still living and trying to improve and work on the relationship....

may be you might be comitting fraud that is why you think others are like that.....for your information i am not having sex anymore......and not planning kids but i have a doubth my wife is pregnent and npt telling me....doing sperm test is ritual in my community before getting married....have agreat life man!!!! fraud people doesn,t try to work on their marriages...instead they try to focus and advise others.

the fact of the matter is you do not have a VAWA case. Period. You have 2 choices. get divorced and remove conditions on your own with a divorce waiver. or stay in your marriage. there is no waiver for someone who can't make up their mind. I;m not sure what you are not understanding.

You have received appropriate immigration advice here that you are ignoring. Divorce, file with a divorce waiver, and move the hell on.

If you are really being abuse, you would try to get away from your abuser ASAP. But have you left? No. Instead of filing with a divorce waiver and moving on, you:

1. Want to work on the marriage. This is fine. But don't come here trying to see if you can apply with an abuse waiver as a "backup" of it does not work out.

2. Are fearful that she'll contact USCIS and have your application denied. I've already pointed out that with evidence this is not a possibility. Yet you seem OK with the abuse, hence you are still living with her, as long as a green card is in the future for you. What is worse? Constant physical and emotional abuse or an inconsequential letter from someone who holds no power over your green card.

Look, stop being stupid. Divorce and move on!
