I just got married about a week ago and now i'm preparing all the paperwork for my CR-1 application, since there's too much information out there I was wondering if you could let me know if I got this right.

Step 1

  1. Fill I-130 (filled by the American spouse)
  2. Fill G-325A (filled by the foreign spouce)
  3. G-1145 (optional)
  4. Payment (how much?)
  5. Cover letter
  6. Birth certificate of the American spouse
  7. Marriage certificate
  8. One passport photo of the american spouse
  9. One passport photo of the foreign spouse
  10. Evidence of marriage (lease, pictures, marriage license, travel history, same religion)

My question/facts are:

  • We still don't have a joint bank account, but that's easy to do... should I do it tomorrow?
  • We have no children.
  • We have been dating for almost 2 years now, we both share the same religion and have been living together for over a year.
  • We signed a lease together.
  • I'm still on a tourist visa and we are taking a cruise to the Bahamas next month for 4 days. Will I have any trouble when I come back? Should I bring a copy of my package with me to show that we already have an application pending?
  • Should I cancel the trip?
  • We currently live in NYC but my wife just received an offer to move to SF in 2 months, should I apply using the NYC or SF address?

I understand that after a few weeks/months we will receive a package with a few more forms to be filled and sent back for the second phase and interviews.

Can you let me know if I got this or if I need anything else? Thank you all for your support and time!

You both have to do a G-325A.

Payment is $420

How can you be living in New York on a tourist visa? Tourist visas are to visit, not to live. Is the 4-day Bahamas cruise in the hope that you can re-enter the USA for another 6 months on your B-2? That's not the purpose of the B-2 and a side trip to Mexico, Canada or the Bahamas does not re-set the clock on a tourist visa. CBP have seen that trick many times.

I haven't been here for 2 years without leaving, I still have my company in Brazil and travel back and forth every few months.

The trip to the Bahamas has nothing to do with my 6 month period, I believe I still have another 4 months on my current visa.

I didn't say you have been in the USA for 2 years.

You said you live in New York City. How much time of each year are you spending in the USA and how much in your home country?

There is every chance you will be denied entry after your Bahamas cruise - especially if you are entering the country regularly and for extended periods. Only US citizens have the right to enter the country unchallenged. The rest of us must overcome the assumption that we intend to stay illegally.

Im spending less than 5 months a year in the US.

Should I take a copy of my entire process with me and show it to the immigration offices if they ask me anything? Will that be a reason for them to kick me out?

It is recommended to travel with all your documentation to prove that you are trying to lawfully become a permanent resident. In the meantime, you have to maintain strong tie with your homeland in order to prove that you have no intention to immigrate until you have been approved. I don't how hard it is for Brazilian to prove that to Custom agents but a good practice is to always have a return airfare booked and have a job in your home country.

I understand your point. I'm actually the CEO of my company and work most of the time on-the go.

I still have a few more questions and would love your input.

Okay, then your post suggests you are following the wrong process. And you can't go on your cruise next month or you will formally abandon your Greencard application.

There is a huge flaw in your plan, OP.

You cannot go on the cruise (or leave the country for any purpose to go to anywhere) during the adjustment from tourist to resident. And you cannot enter the country after the cruise with the intent to stay and adjust.

Either you adjust now and skip the cruise. You will not be able to leave the country for at least 3 months from filing date (you need to wait for adavanced parole to be granted).

Or you go on the cruise, start the I-130 process and return to your home country and attend the interview there. Expect that process to take about a year.
