How old is the child and did her mother marry her stepfather before she turned 18?

The USC should file as that is the fastest path. Does the child have permission to immigrate from the parent who isn't in the US ?

I told her about the permission thing ..she had gotten that about a year ago stamp by a notary I didn't ask if it was still valid

You can't take you with her now on any other visa other than immigrant since you intend on her immigrating to the US. Let her stay and have your husband file for her. It should take about a year.

Thanks I hope the filing will work out quick enough to get her in school
