Good Idea. My husband dad is not doing well and my husband is worried his dad might die before he get to see him again. Will see if we can get a proof of emergency and try to get an approval sooner than 90 days.

If your husband do want to get an Emergency Advance Parole he should not call USCIS. He should go to your local office ( he does not need to make an appointment) and bring:

Evidence of the emergency (letter from the doctor treating his father)

AOS case number

2 passport photos

A check for $360 if he has not filed for Advance Parole

If granted he will receive the Emergency Advance Parole right there and then and he can leave the country immediately. When he comes back he will (most likely) have to go through secondary as I was told this is routine procedure. Be prepared that being in secondary can take a long time which is good to keep in mind if he has a connecting flight. I was in secondary for almost 2 hours.

That's correct, he does not need an appointment. He just needs to go there and tell them he wants to apply for an Emergency Advance Parole. I did that last year when my dad was dying in cancer and I had no issues. I also had to pay $360 because our Advance Parole file was not in their system yet. I went there as soon as I had gotten our AOS case number.

Based on your timeline you could very well be close to getting your green card.

Just because you got yours issued on that day doesn't mean everyone will. USCIS may not agree that it's an emergency.

If they don't agree with it then they will deny you that day but you will find out that day and you'll either get it or you won't that day Edited by Moslund

The OP says the husband feels the father is dying. If that's true and they get it in writing from a doctor I don't see why they wouldn't get it. But yeah, if he is only sick then possibly no. But people have received Emergency Advance Parole to go to weddings so....

I think you should ask to the lawyer. because is you didn´t file the I-131 when you introduce you papers then your card will never say that you can travel. Is presented at the same time, this price is included.

If this is an emergency, dont waist time and determine if you fill it or not and in case of not, then go for it even in emergency it is not that fast to have it approved, now i think that you have to pay us$ 360.( not sure if you have to pay Biometrics again).
