Hi!

Im going to travel to US for the first time with a Green card, I was petitioned by my mother as a single son over 21 and since that time I met my girlfriend we moved in together and she is currently pregnant with twins! She also 10 years of visa. We are not legally married.

Now here is where I get confused, we are going to travel together to the USA, she is coming back in a month, our plan is to get the married in the US **but she is coming back** and not overstaying or anything like that. According to what I read online, entering with intention to get married on a tourist visa is illegal... Is it also illegal if she comes back? The consular officer at the interview told me that I can't get married before I enter the US for the first time, that is why we want to marry in the US since I cant come back for at least since months due to money issues.

Anyway, what is the best way to handle my situation, any help is appreciated.

hi

no, it's not illegal to get married on a tourist visa, the illegal part is the intent to stay

as long as you get married and she returns to wait for the GC in her country, there is no problem, plus you are only a GC holder, so she can't adjust status in the US anyway

the process will take around 2 years, but if she has a tourist visa, she can come and visit you, as long as she never overstays

Coming to the US with the intention to get married and then returning home is legal.

Coming to the US with the intention of marrying and adjusting status is illegal and immigration fraud (and I don't know if that'd even be possible for a wife of a green card holder).

Just make sure that she leaves before her I-94 expires.
