New to K1 & extension

Hi everyone,

I am very new to the k1 visa and are still trying to understand everything.

I am a Swedish citizen living in London and my fiancé is American living in the US, he's in the military.

He is going away with the military in October this year so our plan is to send in everything before then, our only concern is that noa2 (the approval of I-129f) is going to come back super quick, as you then only got 4months to pass the medical exam and the interview. My other concern is that I don't want to leave my job until end of June next year as its before the contract ends. Do they take these things into consideration? Could we apply for a extension of these 4months? As he will be away until April/May and it might take him longer to receive and send documents to me.

I am just thinking if noa2 comes back in December and I have to finish everything everything before March/April and the medical exam is only valid for 6months. I really don't want to leave my job before the contract ends.

If Noa2 comes back by December, you got 4months to process it (medical exam and interview). Lets say you got the visa by March/April, the visa has 6months validity. You have 6months before it expires (September/October). Also, if the visa expires without using it, you can request to re-issue a new visa from the embassy but you will have to pay the same amount for the visa fee.

But what about extend the 4 months after the noa2? Isn't that the best thing to do as my man Will be away with the military and might have trouble to send forms from where he is.

Yes, the consular officer may extend the validity of the petition. It is usually done in increments of 4 months up to a full year. It is not guaranteed that they will, but in most countries and cases (incl UK), they will do it almost automatically.

I had my petition extended in Sweden with no issues. I sent them an e-mail before the original expiration date, to notify them that I was still pursuing the visa. They told me to bring an updated letter of intent and proof of ongoing relationship.

Once the visa is issued it will be valid until the expiration of the medical (usually 6 months from the day your medical was complete).

If it isn't difficult, it isn't worth it.

You do't really have anything to worry about. London's procedure requires a new letter of intent be brought to the interview if it is after the four month expiration date for the Noa2. You don't have to ask for any special extension before that.

Your fiance's documents will all be provided with the petition. Once the case gets to London, the visa part is really all about you and your forms and documents....your form DS-160, your passport, birth certificate, police certificate, etc. All you will need from your fiancé is the I-134 affidavit of support with proof of income and a new letter of intent (if needed). All he will have to submit as proof of income is something from the military saying his salary. Do not believe what you read about tax returns, bank letters, and such. For LONDON, one document from the military or his commanding officer will cover proof of income.

A basic plan for you is

--proceed with the petition and wait for NOA2

--let the case go through the NVC in it's own time without you calling or doing anything

--let the case arrive in London and you receive a letter of instruction

---then STOP the process until the timing is right for you. No worry about expiration.

--when you are maybe three months from your desired moving date, make a medical appointment, submit your two online forms, and pick your interview date (online).

--go to your interview with a new letter of intent from your fiancé, in addition to the other required documents.

So we should send it all in before he leaves in October? Some people have told us to wait until the new year to be sure that it doesn't come back to early but on the other side - I don't want to renew my contract after the summer and then still leave in the middle of it but if a extension is possible after noa2 it should be ok to send it in asap(?)

I325a form - I have changed job mostly every year as my jobs have only been 12months long so all my jobs the last 5years won't fit in. Do I just write them on a separate paper? Is it ok to write the forms on computer and then do the date and sign by hand? Or do the date have to be written in the computer as well?

It's up to you, but I would (and did I guess) choose to send the petition early, and rather delay after the NOA2 is safely in house. Nobody knows if processing times may slow down again in the future.

Yes, include separate sheets for information that don't fit on the form - remember to reference it on the form.

You can fill out the forms and add date and signature by hand, no problem.

If it isn't difficult, it isn't worth it.

Great, do you know how picky they are on the employment dates? I can't remember exact dates :0

You don't need that.

Other questions:

Type/hand write - doesn't matter

Not enough space- write on form "see attached page" then add your page to end. Head extra page with your name and Form xyz item 25b List of blah, blah blah...

Exact dates- if you don't know the dates, then USCIS won't know either. Do your best.

When to apply- Before he leaves. You can stall the London part to fit your schedule with no problem.

I was reading as well that the US citizen (petitioner) has to have a passport valid more than 5 years and copied all pages and sent in, is this really true???
