Hello everyone, Just a couple questions...

My wife from Croatia has been here now for over a year. She got her work authorization card about 9 months ago and a few months after that she got her green card. I remember reading that authorization to work expires after a year and we need to send in a renewal application. Is this true even if she has a green card? Does the green card automatically authorize her to work as long as it is valid, or do we still have to apply for work authorization every year? If we do need to renew it, what form do we send?

Another question... I think I know the answer to this, but we are planning to go back to Croatia for a visit in a couple months. Is my wife's greencard enough to get her back into the U.S. without any problems, or does she need any other special travel documentation? Any help would be greatly appreciated. Thanks a lot

FRUPI:

As specified on the Green Card itself, as a Permanent Resident your wife is authorized to reside AND work in the United States, therfore she doesn't need any other documentation. She doesn't need the EAD anymore.

As far as traveling is concerned, she can come back to the US with her unexpired passport and Green Card, she won't need anything else as the Green Card authorizes her to travel.

Just one thing though, if your wife's passport is under her maiden name, the airline ticket needs to match the passport. If the Green Card is under her married name, she just needs to carry a copy of her marriage certificate as proof of her name change.

Hope it helps!

Thanks for bringing that to my attention, Inlove_tx. I am going to get those tickets this week too. That could have been a costly mistake. Just to clarify, Her passport is in her maiden name and her green card is in her married name. In this case her airplane tickets MUST be in her maiden name and we need our marriage certificate to show that her last name has changed. Is this correct?

The GC gives you authorization to work. Just remember to file to lift conditions about 90 days before he conditional GC expires. Good luck

It's very important that you and your wife understand her new status in the US!

A person with a Green Card is a Permanent Resident.

Note: If you have been married for less than 2 years when you enter the US or have your status adjusted to Permanent Resident, your Permanent Resident status has “conditions”. A CR PR is no less a PR than anyone else, but they do have an additional step to take 2 years after they enter the US. Please see the Guides for Removal of Conditions (form I-751).

I recommend the following reads to anyone who is becoming or already is a Permanent Resident, so you can better understand your rights and responsibilities.

Permanent Residents may live and work in the US and may travel internationally without additional documents. Restrictions to these permissions are on the first linked page.
