I don't know how all this works but my best friend uncle filed for their mother(sister to the petitioner) back in 2002 or so. When the time came, they were all able to move to the US. She was 28 at the time along with her other siblings who were even born later. They came in 2014.

the CSPA thing is good but is unfair to some people. sometime the case take 5 yrs to get approve like my friend case. so they got 5 yrs deduct from their actual age and still qualify for visa . In my sister case they got approved in just 8 months so 1 of their children aged out at the actual age of 22.

So CPSA would take the time from the first notice Dec 2004 to the second on Sept 2009 away from the childs real age. Exact days will count. So you take about 4 years 9 months off the age. If you have exact dates you can use a calculator if you think you are close.

This will not be over quickly. You will not enjoy this.

have you received any confirmation on your brother's case yet? a friend or our is in the same boat their PD is Aug 2003 for F$ the parents go their interview date but the son didn't receive anything yet and when they called NVC they were told it's up to the embassy to decided. but going thru all the process I did find one error in their application that may be the reason why the son's name didn't show up on IV fee invoice or interview letter. there is question on DS260 see the picture that was answered no. it's the 2nd question that was answered wrong.

yes same thing is happening with us our case got approved in 1 year and 2 months 

and now both the sons aged 23 n 26 are aged out and they have to live alone in India while we will have to immigrate to US soon

really sad and unfair

Why do the parents have to immigrate?

 

Could they be found wives if the parents have to go.

If the sons are adults, no worries about them being alone in India.

If not old enough, then parents may opt to stay back. No law that they have to immigrate to the US. Nothing unfair!
