another tax/NVC question

Timeline

I understand that the NVC does a complete background check for the US citizen but was also just told b a friend that NVC checks with the IRS and will refuse an application if back taxes are owed even if a pament plan is in place... is this the case?

I have never heard of this. Can your friend point to a source for this information?

NVC requests tax authorizations to check if the tax returns you submitted are correct. They don't care if you owe money to the IRS. That is between you and the IRS and has nothing todo with NVC.

thanks so much for the response...she was given the information from an immigration lawer from a reputable law firm...she was advised that all past IRS debts ( no matter how small or involved in a plan) must be paid prior to submission of the petition to the NVC or a denial would occur...didn't matter when all were resolved but that this was a part of demonstrating good character on the part of the US citizen

I'm not a lawyer, but "demonstrating good character" on the part of the petitioner is not a requirement to petition for an immigration benefit. I have never seen anyone on VJ complaining about NVC denying a petition because of taxes owed. But then again, I'm not a lawyer.

no neither have I( seen it as a reason for denial)....but after she mentioned it, I started to wonder... I am in a plan and it would be a hardship to pay off ahead of schedule( it is from 6 yrs ago )but if it was a reason for denial I would look into taking out a loan ...

The NVC is not IRS. It is the job of the IRS to chase taxes.

If the NVC is satisfied with the Tax information with respect to the years requested, then in my opinion, it should be OK.
