My eldest son(us citizen) will turn 21 next month and planning to petition me and his dad. If ever approved my other son will turn 20 next year and my daughter 19. Can i file petition for them as soon as we arrived in the us? Or do we need to wait for greencard?

You can as soon as you arrive, they will need to remain unmarried.

You do not need to apply, CSPA will be taken into account.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you are approved, once you enter the US you will receive an I-551 stamp in your passport. This acts as proof that you are a permanent resident until the physical green card is in your hands. You can use that stamp to file for your son and daughter.

What month is the 20 y/o birthday? That will help get an idea if he will age out or not.

CPSA will help. It will take the time from when the recieve the petition to the time it gets apporved off the persons age. The wait for an LPR to petition a child is about 2 years so it is likely the oldest will be too old . The youngest might age out if the wait goes up.

This will not be over quickly. You will not enjoy this.

The son can not even start the process until next month,then a year say to enter.

Pls enlighten me. If our petition will be filed this coming 1st week of oct this yr and lets say it might take a year before we get there. My 2nd son will be 20 nxt yr oct and my daughter 18 jan nxt yr. If we will file the petition oct next yr, as soon as we get there.. How long the petition for them will take? Thanks in advance, im not familiar with cspa and how it works.

You can petition both, just a question of how long it takes.

I would expect a few years for Daughter and a lot longer for son.

Approximately 2 years for the daughter and 11 years for the son. If they get married during this time they cannot come.
