Hallo it is my first time to write here on this forum. It's all about my mom. My mom and dad married in catholic church and divorced in sharia court fast forward..

My mom received the merraige of certificate with this messages ( SHALL HERBY LEGALLY DIVORCED AND THEIR MERRAIGE BOND shall have been severed.it is herby the petition wifeto observe an iddah (cooling off waiting period) of 90 days from the execution of their mutual compromised divorced agreement and thereafter if no reconciliation is made.the wife may now used her former maiden name or surenan me transactions) that's the letter writin side of her merraige certificate. It means?

Second my mom recieved nso advisory of merraige there she still married with my dad. I don't know what next my mom have to do. This is the second Time she recieved the same paper advisory of merraige not CENOMAR ?

Is anybody the same situation here as my mom sorry for my english not so perfect.

I don't understand this story at all. Is your mom Catholic or Muslim?

Hallo my mom is catholic. But shes divorced in sharia court law. All is good the only problem is her cenomar she recieved advisory of merraige. Stated that she's married. I want to know how do we know if my mom is already a single do she recieved CENOMAR with her maiden name indices not marriage or just the same paper advisory of marriage with annoted divorced. Very sorry for my english just try to help my mom.

Philipines does not have divorce, thus your mom cannot be legally divorced, sharia or otherwise.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What I read from her cert. Of merraige. Is she need to wait 3 months before she can used her maiden name incase there are reconciliation between my father and her. If no then she can used her former maiden name or sure name. What I've understand if I am not wrong. I guess she just want to make it faster because she want to file a k1 visa to USA and they need the cinomar.

I don't think she is legally divorced. Sharia law divorce is recognized in the Philippines but only for Muslims. I don't think her divorce is recognized if she is not Muslim. Is your father Muslim, maybe?

I am quite curious about your mothers situation sir. My fiancé went through an annulment , uncontested and still took two years and about $3,000 US dollars. We looked into getting a muslim divorce, she would have had to convert to Islam first.Then as you stated , would it be recognized by the Phil govt.? I am curious as to why the PSA does not recognize the Sharia divorce via a CENOMAR. I hate to say it but as others have said without that CENOMAR stating she's no longer married, she is dead in the water, they will ask for that at her interview. I have suggested to many potential suitors of Philippine finance, they send away for a CENOMAR themselves, to spare time and money lost as well as heartache, its only $20. Keep us posted Sir

This is correct. Your mom got married in a Catholic church, so regardless of the Sharia law and since the Philippines does not recognize divorce, she will need to get her marriage annulled before she can receive a CENOMAR. Edited by xmaricrisx

I'm pretty sure that if this worked (getting a sharia divorce despite not being Muslim and getting it recognized by the government), people would have caught on by now and it would happen all the time.

I do realize that sharia divorce IS in fact recognized in the Philippines, but (logically enough) only for Muslims.

She can't make it faster this way. Legally, she's still married. Sharia law divorce is only recognized by the government in the case of Muslims.

I'm guessing there, but it would seem PSA does not recognize a sharia divorce for a non-Muslim (and rightfully so). OP stated her mother is Catholic.

Sorry that is wrong information. There is divorce in the Philippines.

If you are a Muslim, you can take your case to a Sharia Court and have your divorce processed. See Presidential Decree No. 1083 "Code of Muslim Personal Laws of the Philippines"

The steps you must take to present the proper documents to USEM is as follows:

1. Go to the LCRO where the divorce took place. She needs to bring all documents from the court to include but not limited to finality, decision and marriage certificate. Have the LCRO record the divorce. Make sure the divorce was registered at the place that the decision by the court took place (City A, see #5 above). If the marriage took place in another location, then take all the documents from the LCRO "A" that you just completed from the earlier transaction to the local where the marriage took place if different then the divorce location "B".

2. Present all documents with endorsements from LCRO "A" to the LCRO where the marriage took place (LCRO "B"). LCRO B will make an endorsements from the documents from "A". And then pay the fee for the NSO endorsement and the mailing of said documents from NSO to the LCRO A. They will forward to NSO for endorsements and NSO will return to you.

3. Then at that time, upon receipt of the NSO documents make the necessary copies and forward to USEM.

This should satisfy USEM and you will then have completed their requirements. It sounds like a lot of work but the waiting is the longest part as this process can take 4-6 weeks depending on where she lives and the speed of the courier.

OP's mother is not Muslim. She is Catholic therefore it's highly unlikely that the sharia law divorce would be recognized by the government.

Sorry that is wrong information. There is divorce in the Philippines.
