Just so you know OP, there hasn't been a miltary draft in the US for over 60 years!

And nobody every mentioned emigrating to Ukraine or any former Soviet Republic.

Lived in Japan for almost 3 years. Nice place to visit but nearly 3 years was more than enough.

The first part of your sentence is rather unkind.

No as someone from one of the poorest places in the hemisphere, you cannot speak at all for Canada.

Mexico just phoned me please do not try to go there they suggest you try Brazil.

But my husband's does and he was distraught that this was the treatment we received at the Embassy.

Of course the Embassy exists to help USA citizens and advance the interests of the USA abroad.

We can't for the life of us see, how this achieves either objective.

He will take it up with the Ambassador.

Objective? there is no objective of the embassy here. The embassy is not the problem. You are the problem. You don't want to follow the rules. Be sure to tell the ambassador about all the negative things you had to say about my country. I'm sure then he will see how deserving you are!

My husband has lived in Japan three separate times totaling 9 years and could stay forever.

We think North America is better for our children though.

Just because President Clinton, President GW Bush and Donald Trump received deferments it existed into the 70s I believe for Vietnam. Off the top of my head nearly 60,000 Americans died there and many people ask for what?

Uzbekistan - many people from there want to immigrate to the part of Japan that I live in.

*Generally they are as I wrote:

1. To assist citizens and companies of the USA in the host country

2. To advance the interests of the United States

Making me go through the immigration process all over again and separating my American kids from one of their parents for a year or so, doesn't seem to be consistent with the objectives.

If you really don't think the Embassy has an objective or objectives - what do you think it exists for? In Japan it is one of the largest buildings and the most protected / guarded in the nation.

What are American taxpayers paying for if there is no objective?

Thank you, yes, it is something we well consider, given Canada's much more logical or modern presence requirements.

The banking sector, is HQ in Toronto which often ranks as the best city in North America.

It is an easy trip to my in-laws in New York.

Toronto itself is quite multicultural.

The US Immigration law still allows to reside abroad with your US citizen spouse if he is engaged in a qualified employment overseas and you are entitled to follow him. In this case you don't lose your residence.

Yes, to make a rational / logical decision; we consider all relevant policy.

The reason I started this tread was that I failed to see the logic behind the 1 year rule.

No one has demonstrated any benefit to me that the US receives from this arbitrary time limit,

Rather many parents and children with one party being eligible and the other not have had their lives turned inside out.

As you were told earlier, you would not be separated from your family for a year. The whole process takes a year, but the USCIS part (I-130 petition approval) is about half of it, during which there is no need for anyone to leave Japan. At the NVC stage, I-864 therefore domicile requirement for your husband comes into play. Depends on the particular Embassy if your husband has to physically move or showing documentation such as lease for future home, having a DL, etc. will do, but even if he's required to move back physically, you may be able to get ESTA and visit him for 90 days on the VWP during that time. Many families petition while living abroad. Often, no physical separation ever becomes necessary, they just wait together in the foreign country until the immigrant family member receives their visa then move together to the US.

I think if US Spouse is working for the US GovT or Military or even a US company (maybe)

then perhaps not.
