STARTING VISA PAPERWORK WHILE SERVING EGYPTIAN MILITARY TIME

Hello!

My fiance is a 25 year old Egyptian male serving his military time. He will complete his service in June of 2017.

We want to be together as soon as possible and are confused on weather or not we can start the visa paperwork WHILE he is serving his time? The reason we are confused is because part of the paperwork requires a sign-off from the Egyptian military that he completed his service....but he is still serving right now? We just want to get the ball rolling with the paperwork to eliminate as much of the wait time as possible!

He was told by another soldier that he could not start the paperwork till he completes his service, but that would mean we wont be together for at least another 2 years :(

We just want to know if we can start the paperwork now, and if so...which would be quickest for our situation? Fiance or Spouse Visa?

Nevermind. I see what you're asking now. You want to get up to the last step in the visa process and then finish it off as soon as he completes his service next year. If you want to delay his process, I'd say your best bet would be to marry and file for the spouse visa because it's easier to postpone the steps that way (if needed) and you don't have to submit military papers for the beneficiary until the file gets to the end of the NVC process then.

You can begin the paperwork, but it will be a waste of time. The Egyptian Military will not allow him to leave until his time is served. This happened to an acquaintance of mine and he had to finish his military before he could even begin the immigration process.

You can start the paperwork but as others have said, he won't be able to leave until he has finished.

If you want to do the fiance visa you can do the first steps in the application without the military sign off.

They won't ask for that until you get to the embassy/interview step of the process.

However the first steps (applying to USCIS) only take a few months for the K1 visa so it doesn't make sense to start that till you are closer to the end of his military service.

Our fiance process from filing July 5th to visa in hand Nov 3rd was less than 4 months for the k1. Usually it takes a bit longer though. Our hold up at the moment is since my fiance is a student at his university and exempt from the military while a student and under age 28...he was told to wait until January to travel. So even though mine has his visa in hand, hes still waiting for the moment he can get this military travel permission. I really dont know what the best option to do for you but I do know as 10 years ago I went through the spouse process from Egypt that that process took 17 months so it is much longer for that one.

6/25  Engagement day on the Nile River in Zamalak Cairo, Egypt 

K1 Petition:

7/5 Sent

7/6 Received

7/8 NOA 1

8/24 NOA 2

9/9 Received at NVC

9/13 Received case number for Embassy

9/18 Embassy received our approved k1 petition and emailed Packet 3 to us.

10/1 Mailed out Packet 3

10/3 Embassy Received Packet 3

10/4 Received Email from Embassy & Case # downloaded & ready to pay visa fee!

10/24 Interview

10/24 Visa Approved!

10/27 Visa Issued!

11/3 Visa in Hand!

12/7 Entry to Houston, Texas

12/16 Wedding Day!!!

1/17 Filed AOS

1/24 NOA

2/13 Biometrics

2/17 AOS is ready to be scheduled for interview.  AOS, EAD & AP pending approval. 

4/21 EAD/AP Approved!

4/29 EAD/AP Card in hand!
