It depends on if you are in a no fault state, what the time limits are, etc.

In Illinois, for example, it's a no fault state so you can claim irreconcilable (too tired to check spelling this morning) differences but you have to live apart for 6 months before it's granted. BUT, if you have grounds (mental or physical abuse) your divorce can be granted immediately.

So, will a judge say no? Not really, they will just expect you to comply with the laws of the state.

in texas.. you dont have to be apart for any period of time. you can Divorce provided the other party

is aware you are divorcing them. the 2 ways are 1.. waiver or 2. citiation.

my ex husband kept saying that- he would not sign divorce papers and that.

but, in a no fault state he dont have to sign nothing. he just had to be served and he did not have to

appear in court only I had to appear. like magic the divorce was granted.
