I recently moved back to the US, single mom with 3 kids and now pregnant with my 4th one that's my fiance. I wanted to petition him since I'm on my own here with my 3 kids and pregnant with his. He wanted to be with soon as possible. Do I need a co sponsor for I dont have work yet at this time or he has to have the co sponsor?

You need a co sponsor, not the beneficiary. And you need to meet above poverty guidelines. I don't know how it works because of the children maybe someone else can give you more insight on that but you definetly need a cosponsor.

Just to clarify, it can be anyone who is a US citizen or permanent resident.

The issue is that the fiance in this case is in the Philippines; the US embassy there often doesn't accept co-sponsors for K1, especially if they are NOT close relatives. So in this specific case, because of the country involved, yes, try for a close relative if in any way possible.

That being said- you will only need to prove the financial support at the K1 interview, and then again during AOS after the wedding in the USA. So that means you have several months to find a job and provide paystubs, if you think you can get one whole pregnant. Once the child is born, you will be a household of 6, meaning the minimum income is $40'725

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just to clarify - you are a US citizen? Only citizens can petition for fiances.

99.9% of time the Philippines does not except a cospnsor. But we have seen a few cases where they have excepted a co-sponsor. If you go this route you'll have better luck with immediate family to include parents or siblings.

A Joint Sponsor must meet all these requirements;

1. Be over age 18; AND

2. Be either a USC or LPR; AND

3. Be domiciled in the US; AND

4. Meets or exceed the 125% poverty level with income and/or assets for his/her household size.

I would recommend you save your money on a K1 and go to the Philippines and marry him. Return to USA and submit CR1, which the Embassy must take your co-sponsor.

Just to clarify, it can be anyone who is a US citizen or permanent resident.

To insure that the OP has the best chances at getting approval yes it must be a USC or Permanent resident but also must be older then 18. Lastly 99% of k-1 applicants for the Embassy in the Philippines get denied for a co-sponsor. You have to be careful when answering a question like this one because what works for one Embassy doesn't necessary work for another. :thumbs:

If the OP marries in the PI then she can do a CR1 and they must take a sponsor as long as the sponsor meets all the requirements. (see the requirements in my earlier post)
