Hi Visa Journey community!

I'm sure that there is a thread somewhere on this topic, but I was hoping someone would share their experiences,

I am a US citizen born abroad in Copenhagen, Denmark. Now I want to move to the US for the first time with my danish husband.

Our i-130 have been approved, and we are still filing out the affidavit of support. Now I am moving from Denmark to start my new job in New Orleans and attend a big family reunion in a week (flying in august 9th) with my husband.

But I am starting to get seriously anxious about the border protection not letting him enter the US, because of his pending VISA petition.

He has a return ticket november 1st (so he is staying the full 3 month ESTA tourist VISA), a letter from his employer stating his return to work november 2nd, and a statement from our landlord that he will be back in out apartment as well.

Still i cant shake this feeling that he possibly will be denied entry?

Do i have any reason to be worried?

Thank you in advance

Nina, 21 and from Denmark.

Nina.

it is not a good idea to disclose he is going to spend 3 months, as a matter of fact is 90 days which is less than 3 months. you 2 will be pulled aside . They dont care much about letters like that, specially because he is married to a US citizen and people quit jobs all the time .

No one can tell you whether or not you will face problems. All you can do is be prepared and hope for the best. You are getting very close to the 90 days. Have your husband been to the US before, i.e does he have a track record and visiting and leaving the US on time? If so, that usually helps a little bit. You are bringing strong ties to Denmark, that's all you can do. Be prepared to answer questions but don't volunteer information.

Are you flying back to Denmark with him or are you moving to the US for good in August? How far have you gotten at NVC?

Yes he has been in the US before with no problems.

I do have a return ticket with him but I will probably be staying in the US when he returns to

Denmark, it's just nice to have the option.

So we are currently filling out the affidavit of support, which hopefully will be sent off a couple of days after we arrive.

Here is what I've heard from a number of international marriages where one partner was a UCS and the other came from a European country / could use VWP:

Maybe also add some papers that show you're working on the visa from Denmark, in case they are asking. Showing that you're doing it the right way and have already started on the visa paperwork helps for those who can use the VWP. Most IOs realize that it would be crazy to start regular CR1 and pay for it only to abandon it and file for AOS which is more expensive.

1) CBP have no idea you're going through the immigration process unless you tell them or give them suspicion to look really deeply.

2) your husband obviously has proof to show hes returning

3) when he is speaking to the CBP (do not speak for him) about his entry and time being spent he should be truthful and concise with his answers. Dont babble, dont lie.

~~moved to working and traveling during immigration from ir1/cr1 process and procedures~~
