Ok,

So my wife and I got married about 2 years ago however we found out she was pregnant just after. (not my child by blood...but we reconciled) He is my son in all other regard but I need advice on the best way to bring him here. My wife has already come to the states and relieved here green card here so she has permanent resident status. My name is on the birth certificate, the dad is not in the picture and I had a lawyer file for me initially (no longer using her because she was costly) and we are at the NVC stage I have submitted the VI application but working on the AOS stuff now and noticed the track is a bit different between biological and non-biological.

I just want to go the quickest way with no hickups.. hes a great boy and we look forward to having him with us and he is with her grandparents right now in the Philippines.

Why is your name on his birth certificate when you are not his bio father?

The USCIS might think the son is USC by birthright and require you to file CRBA.

You have to file for him as step son through I-130 petition.

You have a serious issue that is not diy. I suggest a very good lawyer.

Hi my friend it's not going to be easy for you to do. First off you should of listed him as your step-son on the i-130 petition now if you have to do the blood test it's going to bite you hard in the ###.. I wish you all the luck straightening this out
