Hi, newbie here. I am preparing to file AOS for my husband. I am a stay-at-home mom and he has been working illegally for the past years. Last year we filed our taxes jointly, but the previous two I was in school, therefore no income. So we needed a co-sponsor to file for AOS, we have his W2s and all his info. My question is, do we need to file any of our W2s, be it his or our joint for 2015? TIA

You must list your Total Income from the last 3 years of taxes on the I-864 and provide a complete copy with all forms, schedules, W-2s and/or 1099s, or and IRS transcript for the most recent year. If you did not file taxes for any of the last 3 years, then you need to follow the I-864 instructions and provide a statement as to why you were not legally required to file.

Having a joint sponsor does not mean the petitioner/primary sponsor does not have to provide an I-864 also. Petitioner/primary sponsor must always provide one.
