Hi Guys,

I have got a joint sponsor for my i-485 application (wife's father), however I understand that he is late filing taxes for this year. He is filing them now as we need them, however, I notice that an IRS-generated tax return transcript documenting the late filing is required if taxes are filed late.

Being from the UK, I am not familiar with the tax situation here.

My question are a) How long will this take after filing a federal tax return and b) How can I get this?

This is a response to an RFE so we are on a time limit (We have untill October). Do we find another Sponsor or just send this in?

I'm from the UK also so I know how confusing taxes can be when it know nothing about them lol I have been dealing with taxes since 2010 I don't personally do them out financial adviser does.. When she files them electronically we usually get our refund check directly debited into the bank between 7-14days... So to answer your question after filing your federal electronically there usually accepted and processed within 2weeks I can be longer but 2weeks max has been my personal experience... If you paper file it and send them in I think the average turn around time is 4-8weeks

You don't need to send an IRS tax transcript. Instead, you can send the entire 2015 federal tax return and a copy of his 2015 W2s.

Many thanks for your replies. I have just touched base with my co-sponsor and he confirmed that taxes are being filed late this year. (The deadline is April 2016 and it is now August 2016 for 2015).

Please see below the instructions for the i-864 affidavit of support (Page 4 of 9):

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting Form I-864A. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a typed or printed explanation.

This would mean that according to the above, I cannot submit my joint sponsor until I can get an IRS-generated tax return transcript for the most recent year's tax return. Am I correct in thinking this?

Can anyone tell me how long it would take to get this?
