Letter Authorizing Child to move to USA.

I am engaged to a Russian woman who has a 15 year old daughter.

We are in progress on getting a K1 Fiancee visa.

The father of the daughter will be visiting, and I want him to sign a letter that authorizes the daughter to come live in the US.

Basically I want the letter to say:

1. I, the father of (name ) , give permission for her to move and live in the USA.

2. We will pay her plane ticket one time per year for her to visit for two weeks.

3. He does not have to pay any child support costs while she is living in the USA.

Does this make sense?

Any comments or suggestions?

Does it need to have any particular format or ??

Should the letter contain financial arrangements? I have no experience with this but it seems to me that immigration is only concerned with the fathers knowledge and approval of his child leaving the country. Financial agreements seem to be a personal matter between the two parties.

True it may be unenforceable.

But I still want to establish an agreement with the father about her visiting, and the financial arrangements.

The other reason is that I want to give him a benefit for him signing it. Otherwise, he could just say no and it would make matters more difficult.

I am not sure if the letter you are trying to obtain will be sufficient for the purposes you seek.

I am not sure he will be comfortable signing a document that says he will not be asked for child support. Can a child or the mother of the child legally waive the father's obligation by signing a letter?

Family law is different in each country, for instance there are countries where parents cannot legally renounce their legal rights, in favor of the other parent, even if both parents agree. As of now, that girl is under the jurisdiction of the Russian legal system. A family law attorney licensed in Russia can help you to figure how to do this correctly.

I assume you have a great advantage because I believe you implied that her Dad agrees with the child moving to the US.

I would inquire what are the requirements for minors to travel outside of Russia?

I would inquire what is required to permanently move with a minor child out of Russia without being accused of international parental kidnapping?

I do not have children, but I have seen other members of this forum relying on the word of the other parent. I have seen cases of parents that agree to the travel and signed the documents, but the day of the travel, they have showed up at the airport saying that they changed their mind. Consult a Russian attorney to make sure you guys will be all set.

If it is a straight forward authorization of allowing his daughter to migrate to the US it would be fine. But waiving child support or any financial obligations makes it more complicated. I agree that you should seek legal counsel versed in family and parental cases.

I know for a fact that simply writing a letter stating that a parent will not obligated to pay for child support does not work in the US. I have had a family member try it. The government can still enforce child support.

Research Russian laws.

You may want a lot but ultimately it's the 15 yr olds parents and a JUDGE who decide support travel and living arrangements.

You need to follow the Russian regulations as well as US embassy requirements for this child's inclusion in the K1 petition.

What "you want" is I belive not as important as what mom and dad or JUDGE want.

I certainly would never allow my Fiancee have anything to do with my daughters custody. Nor would I entertain my ex's Fiancee or wife telling me what I'm going to do or not do with my child.

I also don't know if you can force him to pay airfare for her to Russia as its your Fiancee who's moving from Russia not him. But I could be wrong

If dads supportive I wouldn't overstep my bounds and upset him.
