Hello!

Im sure this questions has been asked here before, but is there a way to bring my spouse to the USA while waiting for a response to the petition? I really miss him and we have already been apart for 3 months (I came back to the usa in March after living in Ghana with him for 8 months). I heard that the K-3 visa can bring your spouse over while you wait, but I have also seen some contradictory information on the forum stating that it doesn't work. Also, how long does it usually take for this whole process to be completed?

Thanks, all information would be much appreciated. I am so new to this and a bit confused. i miss my husband so much and dont know what to do.

I just want to add that the only method that would allow your spouse to come to the US is a visitor visa. And to be brutally honest it is not likely for him to receive a visitor visa for two reasons. 1. Ghana is one of the most difficult countries to obtain a US visa. 2. Your husband already has a petition out so they will look at him as already having a visa process in the works.

However, if he is able to obtain a visitor visa then of course he can visit you. Keep in mind that it will only be visits to the US, not a move to the US.

I just want to add that the only method that would allow your spouse to come to the US is a visitor visa. And to be brutally honest it is not likely for him to receive a visitor visa for two reasons. 1. Ghana is one of the most difficult countries to obtain a US visa. 2. Your husband already has a petition out so they will look at him as already having a visa process in the works.

However, if he is able to obtain a visitor visa then of course he can visit you. Keep in mind that it will only be visits to the US, not a move to the US.

Unfortunately this is true. I know that a visitors visa is pretty much impossible. we tried it, and it didnt work. i was hoping that there would be a faster way. i guess i will just have to visit him for the time being.

A visitor visa from Ghana with a pending spousal visa is not going to happen.

A CR1 for Ghana takes about 12-16 months.

A K3 is obsolete and no longer viable.

The best thing you can do is visit as often as you can and have plenty of evidence from your visits, Ghana likes lots of ongoing

real face time together.

Front load your petition if you haven't filed yet.

Consulate Received : July 30,2014 Transfer to right embassy complete.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Unfortunately it is impossible for your spouse to travel to US while his IR visa is pending approval , we tried it once and lost our tickets . Now our case at NVC for processing since July 2015 ( more than a year ) till we got bored and upset of the long waiting

If this had been possible, we would have all done it

the way the old process worked was a person married and came here and did the interview in the US

they have changed that and interview is now at embassy in spouse's country for many reasons

spouse does not get to come while waiting if POE and immigraiton knows they try

Most everyone who does consular processing is away from their spouse/significant other during this time, you are no different and it's something you should have prepared yourself for before filing. There is no way to jump the line merely because you miss each other, if that were the case EVERYONE would be doing it.

Would you mind explaining to me what front loading is? Also, what is NVC?

Front-loading is loading your petition with a lot of relationship evidence, chat logs, pictures from visits, call logs... anything you can.

"Easy" embassies usually don't warrant front-loading but I've found that most West African embassies are very difficult. We front loaded our petition with all the evidence we could and then brought even more evidence to the interview.

I flew to Nigeria for the interview even though I couldn't enter the embassy. That was our third visit.

If you've already sent your petition, you'll have to wait until the interview to submit relationship evidence instead of front-loading. I'm not sure about sending things to NVC. I petitioned my fiance and the NVC stage is very short for K1's. That could be different for spousal visas, someone else would have to comment on that one!

The NVC is the National Visa Center. After your petition approval, the case is sent to the NVC before being sent to the embassy for an interview.

When a visa is required to visit the USA from the foreign spouse or fiance's home country, the US Citizen should be planning on doing all travel until the spouse or fiance visa process is complete. Having a US Citizen spouse or fiance is clear evidence of immigrant intent. Those with immigrant intent are not qualified to be granted an non-immigrant visa. There are exceptions but they are rare. If the foreigner already has a visitor visa, they usually can continue to use it, but obtaining one once they clearly have immigrant intent, is next to impossible.

Facts are cheap...knowing how to use them is precious...

Thanks for your responses! Just found out today that our petition was apporved. I expected it to take much longer than 3 months for the first part. Once step closer to a visa. I will continue doing research on the next steps to come
