Hello all,

Unfortunately I spoke with the USCIS today and they mentioned that there was a major delay at the Chicago National Office. Advance Parole applications are being processed with the date of March 13th, 2016, which makes my application still in normal processing time frame (even if I filed more that 90 days ago).

I would like to know if anyone else has heard the same.

I see applications from other immigrant timelines that have been approved, with a filing date just before and after me. Why is this and what can you suggest?

Call USCIS and tell them to open a service request since your application is more than 75 days old. Then someone will look into your case and most probably within a week it will be approved. I have seen many people with this experience who got approved after opening an SR. I tried it too, and it worked :D

I just called the USCIS and tried a service request, however they said because there has been a delay at the USCIS, they are currently processing applications from March 13th, my case is technically still within normal processing times (even if i applied over 90 days ago).

Therefore I cant have a service request.

They mentioned that they are currently processing cases from March 13th, not May 7th which visa journey has noted.

I was told there is actually NO processing times. Oh, and also, the 90 days is an "approximation". Have been told many many things and had t2 officers giving me different answers every time I called. One told me I would be approved withing the next 10 days ( I was on day 81, Guess what, never happened.) If you call USCIS, I would suggest to keep a log of all the officers' names (and/or ID) and what they told you. I wish I had done that right from the beginning.

If you are as unlucky as I was, they will never answer your service requests. Make sure you call and ask them to do it, do not do it online. Also, if you are over 90 days, I would suggest maybe getting your State senators and congressman involved.

My EAD/AP was approved in 156 days. We had to contact our Senator and congresswoman to get them to finally work on my case. Don't lose hope, you will have it eventually.

AOS/EAD/AP

February 20th, 2016: AOS/EAD/AP Package sent! (Received 2/25, yay for USPS delays!)

March 4th, 2016: NOA 1 for all 3 applications

March 11th, 2016: Hardcopies with all 3 receipt Numbers received

March 30th, 2016: Biometrics (as a code 2, Maybe have to go again?)

April 25th, 2016: Walk in for the SECOND Biometrics appoinment (Code 3 this time, Officer was not the happiest but told us to come back at noon and he'd let us in.)

May 16th, 2016: Submitted Service Request for I-765

June 8th, 2016: Called USCIS concerning delay, officer put another request in and said the previous one would like be ignored as it was created through their website.

June 21st, 2016: Contacted both NY Senators.

July 1st, 2016: RFIE for I-485.

July 8th, 2016; Sent Evidence Requested by USCIS. (Received July 13th)

July 15th, 2016; Emergency Advance Parole due to Family Emergency

July 27th, 2016; Contacted USCIS Ombudsman as my I-765 has been pending for 5 months.

July 30th,2016; EAD/AP have been approved!

Thanks for the response. I have talked with three representitives and one supervisor, and all mentioned the same thing.... "every case is different and only to wait." They mentioned there was a major delay at the USCIS and a backlog of work and they are currently processing applications from March 13th. However I don't understand how tons of applications that I have seen here on VJ, that are sent in my same time frame as mine, after March 13, are being approved and mine is not.

Trust me, I understand 100% what you mean. I saw people from May get their EAD/AP approved and I filed in January. When I asked why I basically was yelled at on the phone that it doesn't matter and every case is different.

As mentionned, maybe try contacting your state senator and congressman. I think if I had not contacted them, I'd still be waiting.

The 90 day thing isn't a guideline, it's an actual regulatory requirement that USCIS is supposed to adhere to. Big difference, and they should not brush it off like that. If you're past 90 days, you can open a service request online here (and actually past 75 days, why I don't know). They're always busy. Being busy doesn't get them off the hook from their requirements anymore than you wanting to work gets you off the hook from waiting for EAD (however, punishments are large for you and nothing for them because the house always wins).

The VJ timelines here show basically "fastest" person approved. Always the most recent approval's date is listed. It should give a general idea of what chunk of time they're working on but isn't a guarantee or a requirement. It's to help you get a sense of what is happening in "real time".

Just a warning, though. Apparently they enjoy messing with folks who submit service requests. We submitted on Day 105 or something, and got the EAD approval within hours but then also an RFE for the green card. A potentially expensive one, too (they want us to re-do the medicals yay!). Also, RFE's "pause" the 90 day clock and so I'm *hoping* that the EAD was mailed before they put in the RFE but if it wasn't, then we're delayed even longer because we asked why we were delayed...

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:
