I received a notice stating that i need a joint sponsor which i cant find one yet what happens if i dont get one and the AOS is denied? Do we file again?

Hrm, this is a difficult situation. A few suggestions that might work or might not, based on your case.

Going without a joint sponsor:

(1) Try to find a better paying job that will meet the poverty requirements.

(2) Refile your I-864 with any assets you own that may exceed the poverty requirements.

(3) If the I-864 was in error and you do exceed the poverty requirements, refile with W2s, pay stubs, your tax transcripts for the past three years, and letters of employment from your current job. If you can, obtaining a letter from any previous employers from the past year or two could help support your case as well.

If you require a joint sponsor:

(1) Ask close family members.

(2) Ask extended family for assistance.

(3) Look to any long-term family friends.

If you do not have sufficient income at this time to support the AOS, maybe you can make an InfoPass appointment and look to delay the application until your circumstances change? For example, if you know that you haven't made sufficient income for the past three tax years (2004, 2003, 2002) but your 2005 return is significantly higher and you're going to be filing soon, you could submit that with your new I-864. Or, if your job is about to give you a significant pay raise, that might be grounds too. Thirdly, if you're changing occupations, it might be reasonable to look at sending in your letter of offer from a new company.

I really don't know what happens if you can't make the basic requirements and can't find a joint sponsor. Sorry, can't answer if you'd be denied.

Lastly, if your spouse has any significant assets or income, they can file an I-864 as well. There are several couples on the forum that have done just that when the foreign/non-USC spouse has a larger income and/or assets than the USC. It's allowable.

You can't find a family member or a co-worker or a friend or a member of your religious group to be a joint sponsor? That's really bad given you have a choice of many large circles to find a sponsor. If your AOS is denied I believe they deport you or start the deportation process. Good Luck

If they denied the AOS application, you may re-file. But, you will still need to have a joint sponsor or have sufficient income to sponsor your spouse by yourself. You also need to re-file before they start any deportation proceedings.
