Hey there, basically, my wife and I are trying to figure out what the process will look like for us, and what documentation we might need.


We are, American Citizen (me), Mexican Citizen (her), two kids, both born in Arizona.

We have been married for 8 years. Our first year married we lived in Mexico, the next 6 we were in Arizona (her on a J-1 getting her doctorate). After completing her doctorate she and the kids came back to Mexico (2 year rule as her government paid for the PhD), her two years will be complete in January of 2017. I have been in Mexico for a year. She currently has a B-1 tourist visa that was issued back in May. USCIS has been aware of our marital status since the application process for the J-1 visa, and has not been a problem in acquiring that or the B-1 visa.

I am now looking to go ahead and go back up to the states, start working, establish income and be able to get the process going for her residency. I assume we'll be submitting I-130 and I-485 to adjust status on a trip where she goes to visit me with the kids. In terms of documentation, what should we have available to us? Our evidence of the marriage being legitimate is 2nd to none at this point, but in terms of formal paperwork, will a notarized/apostilled marriage certificate from down here suffice? The wedding was here in Mexico.

What else would we need to provide? Thanks in advance!
