Hello everyone!

I got to America a month ago on a K1 visa, we'll get marry in the following two weeks.

My sister is also getting married in October the weeding will be in Colombia. Is there any chance at all that me and my fiancé can go out of the country for a week to be in the wedding?

I read there's a form to fill to go out of the country, how long does it take?

Thank you very much, have a good day ?

No. Your fiancée would need another K visa (since you're not married yet) to return to the United States, you'd have to start the whole process again. She can only travel out of the country after y'all have filed for her Adjustment of Status (Form I-485) together with Form 131 (Application for Travel Document) for an Advance Parole document, and the later has been granted and is in hand.

Processing for an Advance Parole usually takes up to 90 days, but not a lot less than that.

You can try filing for AOS but as stated you will probably not make it as it can take 90 + if she left then you will need to apply for a cr1 and she must wait in Colombia...(if you are married)

Best bet is to skype the wedding.

You can leave but your fiance will not be able to re-enter the US without a Green card or Advance Parole (AP). Then you would have to marry her in her country then wait a year before she receives a visa.

After you two are married you need to file for Adjustment of Status (to get the green card) and AP (which allows travel outside the US) and EAD (which allows working in the US). The cost is $1070 and it takes 3 - 9 months.

Since you aren't even married yet, having the proper documents for you to travel by October is highly unlikely.

It's doubtful you can get AP approved that quickly, but you can try. I've been watching EAD/AP processing times and they are taking the full 90 days if not longer.

Read up on AOS

Hi,

Once you are married, you can file for AP with your AOS. AP takes about 90 days. You are not likely to get it by October. If you choose to leave without AP, you will be deemed to have abandoned your AOS and you will not be allowed to return to the US; you would need a spousal visa which takes about a year. You can request emergency AP, but you are unlikely to get it for a wedding.

Best of luck.

You can marry, file for AOS, EAD and AP. Once you got your NOA1s you can try an InfoPass for an expedite AP. if they'll do it for you or not is difficult to say. Definitely no guarantees but you can try.
