Hello there,

I'm currently trying to apply for a green card through my spouse but I'm honestly very lost through all the information given. Here's an outline of what I have and what I'm going through:

- I'm a Canadian citizen born in Iraq, my wife is an American citizen born in the US.

- We've been married for 5 years and have two children together (Both kids born in the US).

- After our marriage we lived some time apart, then we lived in Canada for a year. For the past year my wife has been living back in the US with both of our kids, I on the other hand joined them about 6 months ago.

- I entered the US legally through land, then made the decision to apply within while here. Canadians have up to 6 months to stay in the US per year, as of next week this period expires for me.

Here are the forms I think I'm supposed to fill: I-130, I-485, I-765, I-864, and G-325A.

I have some questions:

- Based on the forms I have mentioned, am I missing anything?

- I'm a little confused about the medical examination, I understand that I'm able to find a doctor near me but how does this process work exactly? Is there a form I have to print? I get that there will be some examinations but how will they verify my vaccinations? I have the records written in Arabic (I was vaccinated in Iraq as a kid). Do I need to translate these and send them with my application? I'm very confused about this one.

- As I mentioned that there's a strong chance that this application will be submit after next week, which means I will have to overstay. I read in the instructions of I-485 that this may be a problem, will this be a major issue for me or will they forgive me given that I have an American spouse and two children?

I may have further questions but as you can see, this process seems very overwhelming, I genuinely appreciate it if someone is able to shed some light on some of these questions.

Thank you in advance.

You might want to include the I-131 (Advanced Parole) in case you need to travel outside of the country and it's also free.

Additionally, the G-1145 is optional but, it'll give you electronic updates on your case/

Yes. It's Form I-693. The doctor you see will complete part of the I-693 and transcribe the vaccines onto the form as well. You'll also need to see a doctor authorized by USCIS.

No issues since as an immediate relative of a USC, your overstay will be forgiven.

Your US citizen wife needs to apply for you

The USC spouse needs to supply the I-130 and I-864(both with supporting docs). The intending immigrant needs to apply for their own AOS. All the rest of the forms are theirs to fill out. Everything gets mailed together. The OP can follow the guide here on VJ, linked in this thread already.

~ Moved from AOS from Family Based Visas to AOS from Work, Student & Tourist Visas - not AOS from K visa~
