Do you have a copy of i864 filled in by your agent. Check if the total househokd number is 4 due to double counting or due to error.

You said you make well over 25000, what do you make exactly and what did you bring to prove it?

Did you just give tax returns, did you bring employer letter stating what you're slated to make this year, did you bring paystubs for the last few months?



What did your 2015 tax return say since you only worked for 6 months? You say you worked consistently, but then you say that you were out of the country in 2015 and didn't work. Things like that can worry immigration.


They CAN use their own discretion. Even if you meet the requirement shown on the paperwork, they still can decide it's not good enough and want more if they feel they have a good reason to.

We ended up having to use TWO cosponsors for my husband's (then fiance) visa because I had been unemployed for such a long time. The first cosponsor met the requirements needed to cosponsor, the CO told my husband that he still didn't feel it was good enough, and asked for another cosponsor. We provided tax return, W2, employer letter stating time of hiring (years ago) and current projected pay for the year and, paystubs, all proving that our first cosponsor made the requirement, and had been making more than the requirement for years. Sometimes it's up to the CO if they have an itch about what they're looking at.


Check over what the i864 says, make sure it was done correctly. If it was, then you may just have to find a cosponsor.

221(g) are very common, and since NVC didn't catch the household size issue, your family situation/dependent seems tricky. If you need help from here , please share more info as to what was your tax return filing status last year? How many dependent did you claim? When you say you are sponsoring your brother's wife, does he not have enough income? Have you ever filed I-864 for anyone else in the past? Providing these info would give people in this forum to help you.

I'm assuming his brother is a citizen or if LPR, sponsored by someone else and OP's merely a joint sponsor for his brother's wife. If I'm right, he would not have to count his brother.

I just want to say big THANK YOU to all of you. I went to see 2 different lawyer though they have contradictory opinion on whether my income was meeting or exceeding poverty guidelines but they both said that my previous I864 had errors and the best route will be to find a joint sponsor and do as they say.

I will keep you guys updated as i go along and provide final output so that this information could be helpful to others as well

Im surprised you second guessed the emabssy as they were not gonna change their opinion. As they are the final authority on letting your wife out of India

But hey if it made you happy you now have your answer get a sponsor to co sponsor your wife with you.
