Btw.. Does I-485 RIF would effect to my I-131/765? Thank you.

Even if you have a joint sponsor, your husband is still the primary sponsor, and still needs to fill out an I-864 and provide either a tax return or an explanation of why he did not have to file a return. Living abroad doesn't exempt you from having to file taxes (though earning less than a minimum threshold does, varies by filing status).

Thanks, Now we don't even know how to fix up tax return, like how to file past years tax returns....

I know.. but be glad you're case is moving forward unlike us who was stuck on waiting on our bio metrics appointment until now. :(

:idea: May 31,2011-we met thru a common friend in FB (we've been bestfriends since then)

(F) February 24,2014-we officially became a couple

:wub: November 25,2014 - got engaged

(L) March 16,2015- we got married in the Philippines

Our AOS Journey:

March 1,2016 - I arrived in the US with a B2 visa (visitor)

Day 00: August 4,2016 - we submitted our AOS package (I-130, I-485, I-765) (USPS Priority Mail)

Day 0: August 8, 2016 - Package arrived at USCIS Chicago Lockbox

Day 1: August 9, 2016 - Received date in NOA (Form I-797C, Notice of Action)

Day 9: August 17, 2016 - Notice date of NOAs

Day 11: August 19, 2016 (12:26am) - received email notifications that our application has been accepted and routed to the USCIS National Benefits Center for processing.

Day 13: August 21, 2016 - all cases receipts are working online. Registered for email and text alerts.

Day 14: August 22,2016 - got hard copies of NOAs on the mail. Notice date is August 17, 2016.
Day 44: September 21,2016 - called USCIS to follow up my biometrics letter. I was given a referral number & was advised to wait & call again after 30 days if biometrics don't arrived. (30 days should be October 21).

Day 67: October 14,2016 - called USCIS again and request to talked to a tier 2. Tier 2 made request and sent it to my local office. Advised to call back again on the 29th if the biometrics letter don't arrive.

Day 84: October 31,2016 - received biometrics letter in the mail (finally! Almost 2 months from NOA 1 date)

Day 88: November 4,2016 - I-765 (EAD) updated online to 'Case was Approved' on October 31.

Day 91: November 7,2016 - received EAD approval notice in the mail

Day 98: November 14,2016 - Biometrics appointment in Tampa (in and out within 35 mins)

Day 99: November 15,2016 - I-765 (EAD) updated online to 'New Card Is Being Produced'

Day 102: November 18,2016 - I-765 (EAD) updated online to 'Card Mailed to Me'

Day 106: November 22,2016 - I-765 (EAD) updated online to 'Card Was Delivered To Me By The Post Office' and found it in the mailbox! :)

Day 112: November 28,2016 - Applied for SSN

Day 118: December 3,2016 - SS card received in the mailbox :)

Day 172: January 27, 2017 - Received a text message from USCIS that there is a change in my case. I now have a schedule for interview and it's on March 2!

Day 175: January 30, 2017 - Received the Interview Appointment letter in the Mail! :) 

Day 206: March 2, 2017 - Interview schedule.

If you get a rfe, you will get a pink letter in the mail from uscis. It will simply tell you what they want. Also on the letter is the mailing address and whos attention it should be sent to.

Uscis app updated to rfe sent the day we got the letter. It changed to "request for evidence received " a couple of days after the return receipt showed it arrived.

My RFE letter was yellow. Others are pink. I wonder if there is a difference? I sent my RFE paperwork on October 1st, and they received it on

the 3rd. The waiting continues. My case update has not changed since "My case was received" on the USCIS website.

Goodpm, Newbie here, I have already submitted my I864 as the petitioner and primary sponsor along with the I864A from my husband as the household co sponsor. After a month of submission,I got this Request for Initial evidence stating that I need to declare any assets or find a joint sponsor due to unmeet 125% poverty guidelines My question would be Is it still possible for me to have another joint sponsor not living with us and who will file an I864 given that their will be only ONE immigrant?( I read somewhere that if their are two or more intending immigrant a maximum of two joint sponsors is allowed.) Here's my case breakdown

Me as the petitioner and primary sponsor filed I864

Husband as Household Co sponsor filed I864A

Person not living in the same house with enough income will file I864???????

Another question they're also asking for a copy of the applicant's foreign birth certificate. I was quite confused are they referring to my Birth certificate as the petitioner since they also mentioned the applicant or petitioner or they are referring to my mom's birth certificate as applicant? Lastly, Can I also send a copy of our pictures together (mom and I) to further boost the case eventhough they're not asking for it to avoid future rfe. Any inputs will be greatly appreciated.

Timeline: August 25 sent I130 and I485 together

september 10 noa1

september 15 bio appointment letter

september 20 rfe

october 5 bio appointment

Timeline

You can expect the EAD within 90 days from the "received date" on your notice of acceptance. The received date is usually the day after your package is delivered to them.

So for you, if they received your case on August 15th, your EAD should be approved by something like Nov 12th or 13th.

my RFIE was normal white paper.

I was wondering why the different colors and they just have meaning to the uscis officers, the different colors are used to code between the different things that are missing and when you need to submit them. So to us the colors dont matter at all.

For what I understand in your case, you're filing a AOS for your mother?

They consider than your incomes + your husband's are not enough to meet the 125% of poverty level (I don't know your household size)

In your case, I think what I would do is to find a joint sponsor that can meet by itself the 125% (don't forget to consider their household size is being added in the count)

And then send a I-864 form for yourself (and maybe send again the I-864A for your husband) and a second form I-864 for the joint sponsor.

I don't see any issue about adding a joint sponsor in your case.

And send as many proof as you can, tax form, employment letter, any evidences for assets.

For the birth certificate, it will be for the intending immigrant. I got the same RFE even if they had the translation of my birth certificate already.

They sometimes loose some documents

Thanks for the respone, greatly appreciated. In the rfe first line, they were asking for the most recent petitioner/sponsor 1040 w2 etc which I hve already submitted (Tax transcripts from the Irs instead of 1040 and w2)for the latest 3 yrs with the completed I864 and I864a from my husband. Do I still need to resubmit the 1040 and w2 for the previous years or just the most recent one? w I864 and I864A again? Also with regards to my joint sponsor do I really need to submit the 3 yrs ITr or just the most recent one will be enough? Can we just submit the 2 pages 1040 and w2 we cant no longer find the rest of the forms such as the resident income tax summary w2 etc for the joint sponsor and I really want to get this over cant wait for the tax transcripts via mail. I was tryin to print tax transcrpt online for my joint sponsor bt it didnt thru. Lastly, for the apllicant's birth certificate do I still need to attach marriage certfcate for my mom (applcant)showing the change of married last name.thanku

Anyone here on AOS from tourist/visit visa already have their EAD status "card in production" or arrived already?

My Timeline (AOS from Tourist Visa):

8/16 - USCIS received

8/23 - NOA/Priority Date

9/13 - Biometrics letter received

9/23 - Biometrics Appointment

10/? - ???

Next step would be receiving EAD i think, but till now no updates whatsoever ?

My k1 visa expired last sept 30 but we've already received our NOAs, done biometrics,etc. Do i need to file for extending my stay or anything like that? Or do i just have to wait for my AOS process to complete?
