So if you get just the EAD....then you can start working. It sounds like many are having backlog issues with their local USCIS offices, myself included for

Milwaukee, WI. It says processing AOS cases from December 2015?? That's like 9 months? I sure hope we don't have to wait that long to receive the EAD, AOS,

and AP. If the EAD process is about 3 months, then we should get it in late October.

Still waiting.....for my Biometrics letter.

9 months for them to review your case of AOS. It is usually 3 months for EAD

Once you get EAD, you can pretty much do anything ~ freedom of working (except travel oversee). And by the time your EAD expire, you haven't receive your green card yet, you can notify USCIS and also renew EAD. That is worst case senerio. But hopefully, we all get green card before EAD expire.

I have been attempting to find an answer in the forum but can't quite find an answer. We have received our NOA1 as well as our Bio appointment letter yet the numbers do not work on the web site. Is this normal or should I be worried/call USCIS?

Hey we have the same field office:)

no dont be worried. I found today out that uscis has some problems and thats why so many numbers dont work currently. An other reason could be that they are currently doing a background check and didnt put it in the system yet. According to the website, if it doesnt work 45 days after you the email you can call and they try to fix it for you :)

mine doesnt work either :/

Everybody is talking about hopefully getting the EAD around oct-nov. But, what about the AP? I really want to go home for Christmas to see family and friends and tickets are like $1000 now and will go up in a couple months so I don't know if I should risk it or not... Can we make an inquiry for the AP too?

Awesome! Thank you for the information! My wife actually has her bio appointment the day after you on the 8th. I wasn't too terribly worried since we are still getting letters (NOA and bio appt.) but I just wanted to see if anyone else was having a similar problem.

It should come at the same time as AP. You can expedite if if you have booked travel but usually they prefer an exceptional reason. But that should be more than enough time for AP to be approved.

damn guys just realized my wife taxes she filed this year didnt include me in even i have a valid social security number and she file head of household she said she will wait until i get my legal paperwork to start filing together. even we been married since september 2015 .

am i in trouble for my green card application????

tell her to amend her 2015 tax return to married filing jointly. if she has a CPA doing her return for her, tell her to go amend the return.

It is not that hard. It is even better for her now when she fills it under married filing jointly. She may get a lower tax rate or bigger refund or lower tax payment. However, the primary in tax return may be under your name (it is fine if she wants her to be the primary)

I'm not sure about the green card application though, may be you can make an appointment with the USCIS or call 800 number for it.

It should come at the same time as AP. You can expedite if if you have booked travel but usually they prefer an exceptional reason. But that should be more than enough time for AP to be approved.

Sometimes they even have EAD and AP on the same card (as long as you send the form at the same time, I presume).

But I also thought you needed an exceptional reason to travel; from what I read, even if you can technically travel, they might deny you the right to enter the US again....

your AP is approved when your EAD is approved.. if you apply for AP on its own its usually approved well within the 3months... ive seen people getting it approved within weeks when filed alone but when filed with the EAD it will by default get approved when the EAD is approve because it comes as 1 card that can be used for both AP and EAD purposes

I strongly recommend you speak to a lawyer first.

As far as I understand, the value index of AP is close to 0, because it is still highly unlikely they will let you back in the country before you receive a physical green card. However, it all depends on individual's circumstances, hence why I suggest you speak to a lawyer before booking any flights.

You always run the risk of being denied on re entry even with the AP its a tiny tiny tiny percentage but its still a possibility.. Even when you recieve you AP in the mail is states on the letter that even with the AP you may not be granted re entry... i have yet to read about someone being refused on reentry with an AP... Just cause ive not read about it doesnt mean to say it doesnt happen... The only way to really ensure to get your AP early is if you have a emergency like death of immidiate family, hospitalisation of a immedate family member, terminal condition of an immediate family member.. you must provide proof of emergency... if you have financials in the other country like income and if you dont go it could throw you into hardhsip thats another possibily of getting your AP early but other than that they will most likely deny you an emergency AP... Going home for christmas, or a wedding, or just a vacation isn't classed an emergency situation to merit early approval on the AP in USCIS's eye's

Not what my lawyer said at all, as it was more in terms with "small chance you will be granted an entry".

I believe it's different for countries requiring visa's versus countries requiring ESTA/visa waivers.
