Received Welcome letter,but my wife and I am in US.Confused

Timeline

Hello folks,

Yesterday I received welcome letter that states I need to pay fee and schedule visa interview in my country.

Here is my situation:

My wife is green card holder, my category is F2A and PD is 10-8-2015.

Now I work in US by using my OPT extension.

So I am confused why I could receive this letter since I am in US.

And we plan to do AOS in US.

we are not sure what to do next ?

If I stay and do AOS in US, I may need to apply another school and keep me legal in US since my opt will expire this October.

Please advise if you have any idea.

Shot in the dark here but did you apply to adjust from student to F2A or did you straight-up apply for F2A? Because if it's a new visa and not changing visas, then I'd think that yes of course the interview would be in the foreign embassy. Just by best guess though.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

I am confused too. My husband is greencard holder and I am in US with H1B visa, my priority date is 10-05-2015, I tried to send I-485 form but it was rejected twice due to my priority date is not current... How come you can receive welcome letter? did you already apply for 485 adjustment of status and which address did they send you the letter in US or China?

I was also rejected due to priority date is not current since USCIS use the final action date for AOS.

They sent me welcome letter by email. Interesting....

As long as you think you will be in valid status till you can file i485 which could be several months away or may be more than a year away from now, you can simply let NVC know that you will be doing AOS with USCIS and then you don't need to do anything with NVC even if you get the welcome letter. For i485 filing eligibility, you have to check USCIS visa bulletin to see if USCIS is using Table A or Table B. These months USCIS is using Table A which means only after your PD becomes current, you can file i485.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

Ok. So you're in the country with an F1 and are trying to change to F2A? Why didn't you adjust status right away? You've basically applied for an immigrant visa. Visas are for crossing borders. Status is for staying. If you were eligible to adjust status (from non-immigrant to permanent resident) while still in the US-- that's the route to go. But you applied for an immigrant visa (the type of visa that automatically results in permanent residence status)-- to cross the border again. Visas are processed in embassies abroad. It really looks like you should AOS in- country (if eligible, seems like there are many circumstances under which you could not be eligible). So this is correct. You would need to attend the interview in the US embassy abroad.

I plan to do AOS here but my PD is not eligible according to USCIS visa bulletin.And I have to wait and keep my legal status until I can.

Recently I receive welcome letter what for people are not in the states. That is why I am confused..

Thank you for your precious advice.

I will email NVC that I will do AOS here with USCIS.

But Now USVCI keeps using table A, hopefully they will use table B soon
